A routine day for a teacher from Ma'ale Adumim ended badly: While waiting in her car for the traffic light to change on Magnes Boulevard in Jerusalem, the driver felt a huge blow to the side of the vehicle, as severe pain began to flood her body with great intensity. It later turned out that the driver of a truck that had stopped behind her decided to make a right turn, and in the process, his truck crashed with great force into the door of the teacher's car, on the side where she was driving. The driver, who was injured in all parts of her body, was evacuated from the scene of the accident to receive medical treatment. At the medical center to which she went, it turned out that she was suffering from injuries in all parts of her body, but fortunately for her, it was found that she was not suffering from any fractures. Despite this, the severe pain that accompanied her for months severely affected her functioning. In her distress, the teacher turned to attorney Itamar Ben Ami, who filed a lawsuit on her behalf against the insurance company 'Shirbit', which had insured her vehicle with compulsory insurance. The lawsuit alleged that due to the accident, and due to the numerous blows she suffered, the plaintiff suffered from back pain, dizziness and headaches for months. Due to her pain, it was claimed, the plaintiff was forced to miss work as a teacher and had to undergo a long series of physiotherapy treatments, which resulted in her losing wages and incurring many financial expenses. As part of the lawsuit, attorney Ben Ami asked the court to appoint medical experts to examine the driver's disability and limitations, but before the court convened on the matter, the parties reached a quick settlement agreement. As part of the settlement agreement, the company 'Shirbit' agreed to pay the teacher compensation in the amount of 50,000 shekels. "The insurance company preferred to 'buy risk', pay the plaintiff a large sum and end the lawsuit "Immediately, thus saving a long process and expensive judicial time," explains Attorney Ben-Ami. According to him, the compromise was reached before the medical experts were appointed, and therefore the fact that the plaintiff no longer suffers from any limitations or disabilities due to the accident was not taken into account. Judge Kobi Assulin of the Petah Tikva Magistrate's Court recently approved the agreement and gave it the force of a judgment.
