Residents of the new Kiryat Karnitzi who purchased apartments in the prestigious Towers neighborhood are launching a fight against the decision to establish a cemetery opposite the towers being built, claiming that this will lead to a sharp decline in the value of their apartments.
This is the cemetery where Sergeant Daniel Pomerantz, 21, was buried, who fell in Operation Protective Edge in the APC disaster in which 6 other Golani soldiers were killed. His mother, Varda Pomerantz, was formerly head of the IDF Casualty Department. After his death, the family requested permission from the authorities to establish a cemetery in the village of Azar and bury Daniel there - and permission was indeed granted. Pomerantz is the only deceased buried in the cemetery, and in Israel, it is forbidden to bury individuals.

The apartment buyers claim damage not only to their property due to a possible decrease in the value of the apartments, but also to their feelings: "This intention of the Ramat Gan Municipality to promote the construction of the cemetery in the complex harms the feelings, property and property rights of thousands of families who have purchased housing units in the complex, as well as of the residents of the area whose homes will overlook the cemetery, funerals and memorial ceremonies. We, the future and current residents of the area, express and will express our firm opposition to the intention to change so sharply the planning trends of the areas immediately adjacent to the buildings being built.".
הרוכשים טוענים כי הקמת בית העלמין נעשתה בניגוד לתוכנית המתאר הארצית, כלומר היא לא הייתה בתכנון. הם גם מזכירים שמרחק המינימום בין בית עלמין חדש לבין "אזור מגורים שמותרת בו בנייה לגובה של שלוש קומות ויותר יהיה מינימום 200 מטר", עפ"י חוק, בעוד שלטענתם "ישנם לפחות 4 בניינים בני 3 קומות ומעלה, אשר קרבתם לבית העלמין החדש קטנה מ-200 מטר אווירי".
רוכשי הדירות מאיימים לפנות לבית המשפט אם דרישתם לא תמולא. לטענתם, יש למעלה מ-100 מתנגדים להקמת בית העלמין, בנוסף להתנגדותם של בעלי הקרקע, היזמים והקבלנים בפרויקט.
בעירייה טענו במכתב רשמי ב-28 באוגוסט כי לא נרשמו התנגדויות למהלך, אולם תושבי האזור מביעים על כך פליאה נוכח העובדה שכבר "גייסו" יותר מ-100 מתנגדים.
