Injured in self-inflicted accident - will receive compensation of approximately 140,000 shekels despite his minor injuries

Not every injury in a car accident ends in permanent disability or loss of ability to work – but even in such cases, the person injured in the accident may be entitled to appropriate compensation.

This is what happened to a young man from Netanya who was injured in a self-inflicted accident and, although he managed to return to full function and even enlist in the army, received compensation of 137,000 shekels, in a compromise agreement, after his claim for compensation was submitted to court.

The rider was represented by attorney Little Bieber Chaikin of the Bieber Lekoa Chaikin Harari law firm.

The incident occurred on the evening of a Thursday in March 2024. The young man, then 20 years old, worked as a courier for a delivery company in Netanya and was riding a motorcycle as part of his job. While traveling in the city, his motorcycle suddenly hit a speed bump, he lost control of the vehicle, skidded and crashed into the road with force.

He was taken by ambulance to Laniado Hospital suffering from pain in his right shoulder.

Tests revealed a fractured right collarbone, along with a shoulder injury. He was treated with an arm sling and rested for several weeks. He was then discharged home with a recommendation for medical monitoring and physiotherapy.

In the following months, the young man continued medical monitoring and physical therapy treatments, but suffered from restrictions in shoulder movement and prolonged pain.

The young man's family doctor determined that he was unfit for work for more than two months, noting that the young man suffered from a fractured right collarbone, limited range of motion in his arm, and tenderness and swelling in the injured area.

Immediately after the accident, the young man contacted attorney Little Bieber-Chaikin, who specializes in personal injury and representing victims of traffic accidents.

About five months after the accident, the young man was scheduled to enlist in the military. According to attorney Bieber-Chaikin, he did everything in his power to fully recover and did not want the injury to affect his military service. Therefore, it was important for him to fully rehabilitate himself so that the injury would not harm his profile.

Indeed, after treatment and training, the young man managed to recover before he was drafted and returned to duty. However, the young man chose to file a claim for compensation for the bodily injuries he suffered in the accident - even if they were not significant.

Attorney Bieber-Chaikin filed a lawsuit, on behalf of the young man, against the motorcycle's compulsory insurance insurer.

The lawsuit claims, among other things, that as a result of the accident, the young man incurred medical expenses, lost wages, and lost income. The court was also asked to award him compensation for pain and suffering.

Immediately after the lawsuit was filed, negotiations began between the parties, and in the end, about six months after the proceedings began, the parties reached a compromise agreement according to which the insurance company would compensate the young man for a total amount of 137,000 shekels.

According to Attorney Bieber-Chaikin, the case illustrates how important it is to seek legal advice and treatment even when the injury appears to be insignificant. Proper management of the procedure, presentation of medical documents, and legal understanding of the long-term implications will lead to an outcome that respects the injured party.
