According to a report today (Sunday) on the B' channel, Rosenfeld - a resident of Bnei Brak - claims that the investigations that are still ongoing violate his basic rights as a defendant, including the transfer of all investigation materials in the case to his defense attorneys.
Recently, the prosecution requested, in a rather unusual move, to postpone the start of the trial of defendants Eli Feldstein and Rosenfeld - given the ongoing investigations of other people involved, which it is not yet known when they will end.
Opponent Rosenfeld noted in his motion: "This conduct - of filing the indictment only to ensure a 'safe transition' from a few days' detention to detention until the end of the proceedings, and even though the investigation has not been completed and the case cannot proceed, constitutes an abuse of power and a cynical exploitation of the prosecution's powers - all while discriminating against the applicant compared to other people involved in the case, whose investigation was not exhausted and who were released without any conditions.".
Last week, Eli Feldstein also submitted a request to be released from all restrictive conditions that apply to him, including house arrest, electronic handcuffing, and more. In the request, Feldstein argued, among other things, for the continuation of the proceedings, and claimed that he does not pose a danger in the documents affair and the Cattergate affair in which he is involved.
The prosecutor's office will now be required to respond to this request, after which a date will be set for a hearing before a judge in the Tel Aviv District Court.
