High Court to Levin: Convene the committee to select judges - or an order

The High Court of Justice responded today (Tuesday) to petitions against the failure to convene the committee to select a president for the Supreme Court, and clarified that if the committee is not convened, Justice Minister Yariv Levin will be required to convene it at the end of the court recess in September.

""At the request of Justice Minister Yariv Levin, we have delayed the decision in this case for a significant period in order to allow him to focus his efforts on fulfilling his blessed vision of bringing about the appointment of a president and justices to the Supreme Court based on broad consensus," the High Court wrote.

Justices Yael Wilner, Ofer Grosskopf and Alex Stein further wrote: "Once it becomes clear that this is not helpful, it is clear and obvious that there is no escape from the decision-making process stipulated in Section 2 of the Courts Law.

""Out of respect for the minister in charge of the judicial system and in the knowledge that the values ​​of the rule of law and the good of the judicial system are before his eyes, we express hope that he will act in the coming days to put this insight into practice.".

The judges emphasized: "Given the foregoing, we clarify that our ruling in this petition will be given, to the extent necessary, at the beginning of the next favorable judicial year.".

Those around Minister Levin responded that this was "an expected decision, with a conflict of interest and a lack of authority. They are their own judges. In effect, they are taking over the committee completely, refusing to accept anyone who is not theirs and are only proving how just the reform is.".

Yesterday, Minister Levin informed the High Court of Justice that no agreement has yet been reached between him and Acting Supreme Court President Uzi Fogelman on the identity of the next president - and therefore he is not convening the committee to select judges.

However, in his letter to the High Court of Justice, Levin revealed the compromise proposal he gave to the acting Supreme Court president, who will retire at the beginning of October.

In response, Acting Supreme Court President Justice Uzi Fogelman announced that he was rejecting the compromise proposal.
