Mandelblit claims in the letter he sent that the state's position is "according to the High Court of Justice's decisions following the early elections for the 21st, 22nd, and 23rd Knesset, according to which Article 38 of the Basic Law of the Knesset applies in our case, the repeal of Chapter 3 will enter into force on July 6, 2021, at the end of the first 3 months of the term of office of the 24th Knesset.".
""For the avoidance of doubt and for the sake of legal certainty, the state proposes that the Court expressly state this in its decision," the Attorney General adds.
Article 38 states that any law that would have expired in the last two months of the term of the outgoing Knesset, or within 4 months after it decided to dissolve, or within the first 3 months of the term of the incoming Knesset – will remain in force until the end of the aforementioned 3 months.
According to Mandelblit, the last three times the elections were brought forward, the High Court ruled that the section also applied in this case.
