A blow to buyers: Did Litzman care about contractors? Reduced compensation for delayed delivery

The Ministry of Construction and Housing is promoting a legislative amendment that will exempt contractors from delays in delivering apartments due to the coronavirus, Kan News reported.

The ministry states that the coronavirus pandemic has caused an average delay of about two months in the pace of construction of new apartments, a delay that is expected to cause a delay in the delivery of the apartments.

According to the amendment proposed by the ministry, at least for part of this period, the contractors will not be required to compensate the apartment buyers for the delay - even if the contract between them includes such a compensation clause.

The ministry submitted a position paper on the matter to a committee at the Ministry of Justice that is currently examining the legal implications of the coronavirus on contractual relationships in the entire economy - and the question of whether the coronavirus will be defined as "force majeure.".
