A former teacher and therapist at a seminary in Jerusalem will pay almost one million shekels to Toby Moses, a student who was her patient and against whom she committed serious acts - this is what the Jerusalem Magistrate's Court ruled.
The court acknowledged the serious harm caused to Toby as a result of the actions of her former caregiver.
Toby filed a civil lawsuit, two years after the teacher was convicted of hundreds of offenses she committed against her over a five-year period.
The teacher was sentenced to 6 and a half years in prison and is currently serving her sentence in prison.
In a conversation with Vered Pelman on Kan News, Tobi spoke about her sense of victory upon receiving the verdict, and the relief she felt upon the teacher's conviction. She said that over the years, there had been a silence surrounding the actions.
Attorney Rotem Aloni Davidov, who represents Moses, told Kan News after the verdict: "This case is a good example of how the civil lawsuit not only provides a response to the rehabilitation needs of those who were injured and acknowledge their damage, it can also be an opportunity to reveal the story of the injury and talk about it in cases where the criminal proceedings were conducted under a gag order.".
The Magen Assistance Center, which is supporting Toby, said: "We welcome the court's decision in the lawsuit. We are so proud of Toby, for the determination and courage she has shown over the years in her fight against the mechanisms of silencing. We hope that this decision will encourage other victims to make their voices heard, and to turn to the legal system in order to exercise their rights and find justice.".
Attorney Michael Tapiro, the teacher's attorney, told Kan News: "Our office has just received the case, and we are now studying the verdict.
""At this stage, it can already be said, with the necessary caution, that on the face of it, the verdict raises fundamental difficulties, both in the exceptional result it reached and in its suitability for the purposes of the tort proceeding - a proceeding intended to compensate for proven damage, and not to serve as a tool of punishment. The matter takes on added force where the defendant is already serving her sentence in the criminal proceeding.".
