Journalist Yoav Yitzhak announced that the Tel Aviv Magistrate's Court dismissed out of hand the defamation lawsuit filed by journalist Dr. Ronen Bergman against publicist Dr. Gadi Taub. Judge Lior Gelbard ruled that the publications do not constitute defamation and that there is no need for an evidentiary process, since the reasonable reader would not understand from them that Bergman acted to sabotage the war effort or commit treason.
The ruling clarified that Taub's criticism was directed against the security establishment and the leakers from within the General Staff, and not against the journalist, and that nicknames such as "court reporter" are protected under freedom of speech and legitimate expression of opinion. The judge emphasized that as a senior public figure, Bergman must demonstrate a high tolerance for harsh criticism, and ordered him to pay legal costs in the amount of 15,000 NIS.
