Legal Advisor to the Prime Minister, Gali Baharav Mayara, informed Prime Minister Benjamin Netanyahu this evening (Tuesday) that from a legal perspective, MK Itamar Ben-Gvir cannot be appointed to the position of Minister of National Security.
According to her, the reason for this is his political involvement in the police, which is inconsistent with the alleged powers of the designated minister.
Despite the legal opinion, Netanyahu announced that he intends to bring the vote on Ben-Gvir's reappointment to the position to the cabinet meeting tonight.
In a conversation between the two, Netanyahu emphasized to the Attorney General that only he decides who will be appointed as a minister, and no one else, and noted that the law allows the appointment of any candidate who does not have a criminal indictment.
Contrary to its position, the Supreme Court this evening rejected the request of left-wing organizations to issue an interim injunction against the appointment of the chairman of Otzma Yehudit to the position of Minister of National Security.
Judge Dafna Barak-Erez wrote: "Considering that no reference has yet been submitted to the body of the claims raised in the petitions, I did not see the need to issue a temporary order ex parte now.".
The government is expected to approve Ben Gvir's appointment to the position at its meeting tonight.
