Parents of girl who was run over to death in Bnei Brak sue 'The Phoenix' for 7 million shekels

A lawsuit was recently filed in the Tel Aviv District Court by bereaved parents against the Phoenix insurance company, for an amount exceeding seven million shekels.

The parents are represented by attorneys Avichai Yehosef and Yonatan Yehosef.

According to the lawsuit, their daughter - a second-grade student at Oheli Shimon Elementary School in Bnei Brak, was seriously injured by a passing vehicle on the afternoon of July 19 of last year, when she was crossing the road on Kahneman Street.

An ambulance evacuated her to the hospital, but the efforts of the doctors who fought for her life were unsuccessful, and she was pronounced dead shortly after arriving at the emergency room.

The offending driver was detained for questioning at the scene of the accident.

According to Yehosef's lawyers, the terrible tragedy left the parents and the entire family in a deep and prolonged mourning. According to the parents, their daughter discovered extraordinary talents, excelled in her studies and demonstrated impressive abilities in the creative fields.

The lawsuit states that the deceased's older sister is employed in the high-tech field, and earns a salary higher than the average in the economy, and the deceased girl, who spent long hours each week with her, was expected, according to the claim, to follow in her footsteps, and reach a salary much higher than the average in the economy when she becomes an adult.

The lawsuit was filed against the Phoenix company, which insured the offending vehicle with compulsory insurance.

According to Attorney Yehosef, the Law for Compensation for Road Accident Victims [Hafaltad] imposes on the car insurer absolute responsibility to compensate all victims or their survivors, regardless of the circumstances preceding the accident.

According to the lawsuit, the parents, who are the heirs of the deceased, are entitled to inherit the full compensation to which she was entitled, due to the lost years and potential income losses resulting from her tragic death.

As part of the lawsuit, the parents present a calculation that estimates these losses based on multiplying the average wage in the economy, taking into account the characteristics of the family and the level of education that the girl was expected to acquire.

The lawsuit, for more than 7 million shekels, was recently filed with the Tel Aviv District Court.

A defense has not yet been filed.
