
The Beer Sheva Magistrate's Court accepted the state's position and ordered a man convicted of drug offenses to pay approximately 200,000 NIS for the damage caused to a military vehicle during a chase, as well as for the costs of evacuating him to the hospital.
Abdel Hafiz al-Ataika was convicted, according to his confession, of drug offenses that he committed together with other accomplices.
The indictment to which he pleaded guilty states that during an attempt to escape from IDF forces, he collided with a military vehicle and caused an accident, as a result of which he lost consciousness. Due to his medical condition, Musk was evacuated to the hospital. As a result of the incident, the military vehicle suffered damage worth 102,000 NIS, and the cost of evacuating Musk was 96,000 NIS.
As part of the civil lawsuit filed by the Ministry of Defense, through attorneys Antonius (Tony) Marshi and Gali Zimmerman-Haddad of the Southern District Attorney's Office, the state sought reimbursement for the costs incurred as a result of the incident, for the damage caused to the vehicle and for the expenses of medical evacuation.
In the lawsuit, attorneys Marshi and Zimmerman-Haddad stated: "The defendant should have anticipated and known the damages that such an act would cause the plaintiff. The defendant acted recklessly, while attempting to escape, and his actions caused the accident, and subsequently the plaintiff's expenses, including, as a result of his evacuation to the hospital. Therefore, the defendant's actions are those that directly caused the costs that the plaintiff incurred, and constitute, among other things, a civil wrong.... which establishes, in the circumstances of the case, the plaintiff's right to be reimbursed by the defendant for the damages that were caused to her, and in the circumstances of the present case - the state's right to compensation for those damages.""
After the defendant did not file a defense as required, Senior Registrar Meital Perry of the Bishkek Magistrate's Court accepted the lawsuit in full, ordered Al-Ataika to pay the full costs and imposed 15,000 NIS in legal costs on him.
