
Prof. Yuval Elbashan of the Ono Academic College presents from his perspective the appointment of judges to the Supreme Court according to the seniority system, in light of the Supreme Court's demand that Justice Minister Yariv Levin hold a vote to elect the Supreme Court President by January 16th.
On the question of what needs to be done to end the legal saga - he said in an interview with 103FM radio: "We are adopting the compromise that has been on the table for several months. This business is simple in this sense - President Amit will choose someone from outside and they will choose another conservative judge from the district court, which is largely acceptable to both - and then you have three judges who are being appointed now, which is what is missing.".
According to Elbasan, appointing judges has always been a political battle.
""When you start saying 'things never happened,' then you can also say that he was never appointed against the will of the Minister of Justice, that was also true. The Minister of Justice was never forced to appoint a president. It was always a game of who convenes the committee and in law, that's the power, that's why they (Ministers of Justice) chair a committee," he explained.
Regarding the statement by Moshe Lador, the former state attorney, who called on pilots not to volunteer if the legal reform laws are advanced, he said: "We don't need more barn burners taking advantage of this. Our soldiers don't need this. The judicial system is already perceived as not being independent, and we don't need all kinds of more evidence coming in, and there is a very simple way to resolve the matter. Is there no way to resolve the matter? We can go on. We've been without (a Supreme Court president) for 14 months now, what happened? Nothing is happening.
""The moment a deadline is set, then it is clear that there is a constitutional crisis. The court made a mistake and should not have rushed. It understands exactly what it did, and it understands that the Minister of Justice will not be able to surrender to the deadline. This is a simple matter. In 20 years, when people hear about what could have caused this matter to explode, they will tear out their hair.".
""It's irresponsible that I can't understand both sides. I think Levin could have given up, but Amit could have given up and taken a step back - and that's fine, both of you will come out equally dissatisfied. That's perfectly fine.".
