The trolling failed: The High Court outright rejected Amsalem's petition to recruit Arabs

Supreme Court Judge Ofer Grosskopf "threw" the petition filed by Minister Dudi down the stairs today (Monday). Amsalem to the High Court of Justice against the Minister of Defense and the Attorney General, demanding the conscription of Arabs for military or civilian service - due to "failure to exhaust procedures.".

Judge Grosskopf addressed the numerous petitions filed by the minister Amsalem, He noted that all petitions were rejected outright. 

""The petitioner, currently a minister in the Israeli government, from time to time submits petitions to the High Court of Justice on various public matters... All of these petitions were dismissed out of hand for similar reasons - either because his claims were made without providing an adequate supporting infrastructure, or because, contrary to the basic requirement of every petitioner, public or private, Minister Amsalem did not file the petition in advance, and did not bother to inquire with the respondents (in this case, his colleagues at the government table) about their attitude to the claims before he submitted his petition," the judge wrote in the ruling.

Minister Dudi Amsalem responded to the disqualification: "With all due respect - it is not possible that instead of being a state with a High Court, we will be a High Court that has a state. With Israel, I told you not to be tense and let them throw us down the stairs. In the kingdom of hypocrites, hatred of Judaism prevails over all reason and justice. They once again claim that we have not exhausted the procedures.".

As reported in Haredim 10, the Minister of Regional Cooperation submitted the petition last Sunday, through attorney Moti Shimon - Against the backdrop of the High Court's decision on the recruitment of Haredi yeshiva students.

The petition states that "the illegal and inappropriate practice of omission and wrongful, biased disregard by the respondents of the existence of Arabs who are designated for security service and military veterans must be stopped.".

Minister Amsalem said about the submission of the petition: "According to the Security Service Law, every citizen and permanent resident, regardless of race, religion, nationality or origin, is subject to security service obligation.
In other words, a person's religious origin is not a relevant consideration for requiring security service or granting exemption from security service.

""However, since time immemorial, the obligation to serve in the security service has not been enforced collectively on the Arab minority in Israel - but it is enforced on the Druze minority and the Circassian community.
Arabs in Israel are not exempt from security service, neither by virtue of Section 36 of the law nor by virtue of any other section. Section 13 of the law states that 'the inspector may' and hence the inspector's authority to issue an order is an authority within the authority. Thus, in effect, the inspector does not enforce the obligation of security service on Arabs in Israel.

Amsalem explained: "I decided to petition the High Court of Justice, through attorney Moti Shimon, because the Arab public in Israel is entitled to the rights that every Israeli citizen receives, but does not bear the burden equally when it comes to the obligation to enlist in the army.

""I don't count on this institution, which I call the Hall of Hypocrites, but I'm interested to see how they will manage to escape making a decision this time, after the decision they made regarding the recruitment of Haredim...

""I am in favor of creating equality in the burden so that all citizens in the country who are entitled to rights will bear the burden of conscription into the IDF or national service, unless they have received an exemption or deferment of service as the law allows - and thus fulfill their civic duty.".
