High Court: Ruling on petitions regarding the Jerusalem Rabbinate - after Rosh Hashanah

שופט בית משפט העליון עוזי פוגלמן הבהיר הבוקר (חמישי) במהלך דיון בעתירות שהגישה סיעת יהדות התורה בירושלים לבג"ץ בנושא הבחירות לרבנות העיר, כי ההכרעה בעתירות תהיה עוד קודם תאריך הבחירות - שאמורות להתקיים בתאריך כ"ז בתשרי תשע"ה. השופט הבהיר, כי אין בכוונת השופטים להוציא צו ביניים נגד קיום הבחירות,  וכי פסק הדין יהיה סופי ויקבע: האם לאפשר את קיום הבחירות או שיש לבטלן לחלוטין. This morning, judges Yoram Danziger, Uzi Fogelman, and Uri Shoham discussed three petitions filed by United Torah Judaism regarding the elections: against the new regulations established by the Minister of Religious Affairs for the election of city rabbis, against the holding of the elections themselves, and against Mayor Nir Barkat. During the hearing, the petitioners' representatives claimed that the new regulations were 'tailored' to the specifications of the Religious Zionist candidate for rabbi of Jerusalem, and were intended to enable his election. According to Channel 7, during the hearing, Judge Fogelman questioned the state representatives about why the process of appointing rabbis was approved through regulations and not through primary Knesset legislation, while Judge Shoham demanded that the petitioners' representatives stop dealing with the identity of the Minister of Religious Affairs, since this may change every few years. "היום זה השר בנט, מחר או עוד שנתיים זה יכול להיות שר אחר שיכול להיות ממגזר אחר. השיקול צריך להיות האם התקנות חוקיות ולא מי שר הדתות", אמר השופט שוהם. השופט פוגלמן התייחס י לטענות שנשמעו על ידי באי כוח הצדדים ואמר שטענות שאין להם תמיכה במסמכים הן שרלטנות. בסיום הדיון נקבע כי שר הדתות והעירייה יגישו תגובות משלימות לטענות שנטענו, לאחר מכן העותרים - סיעת יהדות התורה - יוכלו להגיש תגובה מטעמם לדברים עד ערב ראש השנה - ולאחר מכן תינתן החלטה סופית של בית המשפט  בעתירות. עו"ד אילן קמינצקי, יו"ר נציגות בתי הכנסת הציוניים בירושלים, אמר לערוץ 7 כי הוא משוכנע ששופטי בג"ץ ידחו בקרוב את העתירות שהוגשו נגד קיום הבחירות בירושלים: "משוכנע שעוד חודש וחצי יבחר רב ראשי לירושלים". "השופטים הבינו שמדובר בעתירה פוליטית", אמר עו"ד קמינצקי לערוץ 7, לאחר סיום הדיון בשלוש העתירות.

A senior official in Torah Judaism told the Haredim10, "The very fact that the court did not reject the petition outright, as the state and the municipality demanded, speaks volumes.""

""Judge Danziger," the source added, "the chairman of the panel, also explicitly said that the petition presents a problematic situation in the regulations and therefore it is necessary to hold a hearing on it."".

 Religious Zionist sources tell the Haredim10 that "all these legal maneuvers will not benefit Torah Judaism. The court has shown time and again what it thinks of these petitions.".
