In his decision, Justice Stein sharply criticized the government's conduct and stated: "The transition order should determine that the old support tests will continue to apply until the end of the current school year, 2012. A shorter transition period than this would necessarily be extremely unreasonable and not immediate." As reported in Haredim 10, about two months ago, the High Court considered two petitions filed following the decision. In the hearing, Justices Fogelman, Stein and Grosskopf wondered why the decision was made after the start of the school year and so quickly - not allowing parents to organize other alternatives or prepare accordingly. At the same hearing, the High Court asked the state to provide an answer to the question of why not to postpone the planned cut for the next school year. The state submitted its detailed 70-page response to the court, in which it announced the postponement of the implementation of the decision to January 2022, and claimed that there was no need for another postponement and that the decision should be implemented. As a result, another hearing was held about two weeks ago. During the hearing, after consultations held by the judges, it was proposed that the parties agree on a compromise, in which the cut would be postponed to the upcoming Passover vacation, and would begin on April 13, 2022. A postponement of four additional months would allow thousands of families to properly prepare for the cut. The state representatives went to hold consultations with the ministers, at the end of which they returned and announced that Finance Minister Yvette Lieberman opposes the compromise. As a result, the judges gave their current decision. It is worth noting that another petition is being processed at the same time, also filed by the Emet organization. Yaakov, against the discriminatory criteria set for rabbinical and jurisprudential students, relative to any other student, and requiring these students to prove that they have already successfully passed one test in order to be eligible for funding for the dormitories. The Emet Yaakov organization, represented by attorney Zalman Black, stated: "The legal battle has proven itself. The High Court of Justice accepted our position that the cut was made irresponsibly and inappropriately and postponed it for the next academic year. We welcome the decision and call on the Minister of Finance to cancel the harmful and pointless cut." Attorneys Uriel Stern, Jonathan Feldman and Shmuel Maklev, representing the group of petitioners, stated: "We welcome the court's decision to accept our uncompromising position as presented by us and in detail in the petition and during the court hearings, on the lack of justification for the immediate application of the cancellation of the dormitory subsidy. "We call on the Minister of Finance to make decisions on the matter professionally and according to all the rules of administrative law, and not arbitrarily or based on extraneous considerations. If this is not done, we will not hesitate in the future to turn to the appropriate courts for additional remedies." Finance Minister Avigdor Lieberman tweeted on his Twitter account: "We regret the High Court of Justice's decision regarding changing the criteria for receiving subsidies for daycare centers, which harms citizens of the country who serve in the IDF, work and pay taxes. We will continue to work with all our strength to integrate all citizens of the country into the employment market." MK Yaakov Asher responded: "Even the High Court judges understood that Lieberman's brutal step against Haredi mothers does not meet any legal or logical test and threw him out of all the trouble. I congratulate the Emet organization for Yaakov and the petitioners for working together and determinedly against this draconian decree. With God's help, by next year this evil government will pass from the world along with all its decrees." MK Uri Maklev: "The High Court reflects in its ruling the government's predation and evil in bringing this decree while harming every proper administrator with administrative predation and in demanding that things be done immediately. "At the same time, unfortunately, even in this ruling, the terrible decree that haunts women who support their families still remains - this sword is still hanging in the air and in this the Haredi public will not receive protection from the court." United Torah Judaism Chairman, MK Moshe Gafni: "I welcome the High Court's decision this year to postpone Lieberman's ruling that ultra-Orthodox families will be required to pay the full price for their children's daycare.
