Jewelry company sent 'spam' to 70,000 people: will pay 1,200 NIS per message

A company that sells luxury jewelry and watches, which has several branches across the country, including a particularly prestigious branch in Kikar Hamedina in Tel Aviv, sent a spam message in 2016 announcing a 'unique summer sale', in which a Swiss watch and a ring would be raffled off among those who registered.

As a result, two of the recipients who received the illegal spam message on their cell phones decided to take action and filed, through attorney Matan Freidin, a class action lawsuit with the Tel Aviv District Court, in which they demanded that the company compensate them and all the recipients to whom the illegal spam message was sent.

As part of the legal proceedings, it was revealed that the message was sent to no fewer than 70,000 recipients, whom the company segmented according to high socioeconomic status and place of residence in the established Sharon cities of Ra'anana, Ramat Hasharon, and Herzliya.

Now, after a lengthy legal process lasting almost three years, the Tel Aviv District Court has approved a settlement agreement under which each recipient who received the spam message is entitled to financial compensation in the amount of 1,200 shekels - an amount 200 shekels higher than the maximum amount stipulated by law.

Attorney Matan Freidin: "This is another link in the chain in the fight against the spread of spam - an illegal phenomenon that wastes time, violates privacy, and even exposes the public to the phenomena of spyware and surveillance software.".

""I am glad that the Court has sent a clear message here that there is no longer any tolerance for this illegal advertising channel. I call on the general public not to put up with this phenomenon, and to demand the compensation it is entitled to by law.".
