Journalist Yigal Sarna posted on his Facebook page a photo of Ashi Horowitz from Hebron in which he is allegedly seen smiling and photographing the body of a terrorist. Sarna added the words 'scum' and 'Jewish Cossack Pogromchik' to the photo, and was sued by attorney Itamar Ben Gvir for 100,000 shekels.

Ashi Horowitz, the events director of the Jewish settlement in Hebron, is demanding compensation of one hundred thousand NIS from journalist Yigal Sarna for publishing defamation on Facebook.

A few days ago, Serena posted on his Facebook page a photo taken at the scene of a terrorist attack that occurred in Hebron the day before, showing Horowitz standing next to the body of a terrorist while looking at his mobile device. The caption of the photo said: "Does anyone know who the smiling scumbag on the right is, some kind of Jewish Cossack pogromchik who is smilingly documenting the body of a person who has just been shot?""

He later wrote additional statuses against Horowitz, and the posts drew a wave of comments.

Through his attorney, Itamar Ben Gvir, Horowitz sent a letter to Serena, which read, among other things: "The body of the man who was just shot, photographed in the photo, is none other than the body of a terrorist, who was shot after trying to stab innocent soldiers and civilians, with the aim of murdering and slaughtering Jewish lives in cold blood and without mercy, and at the last moment, fortunately, was neutralized by an IDF force operating on the scene before he was able to carry out his plan. In light of this, your words undoubtedly distort reality!""

Ben Gvir further writes: "In addition to what is required and for the sake of clarity, it should be noted that the 'smile' you mention in your advertisement is not a smile at all! A thorough examination of the photo reveals that it is not a smile, but an instinctive expression (tongue out) that my client has when looking at his mobile phone, and it is known among those around him. This can be seen, for example, in the attached photographs. It also seems unnecessary to point out that statements like: 'Smiling scum... Jewish pogromist' and the like are intended to defame my client and seriously harm him.

""There is no doubt that the things you published are defamatory and constitute grounds for a lawsuit against you, as our client certainly did not photograph the terrorist's body and certainly did not smile at the sight of the body. The words are a complete lie and a serious injury to the good name of our client, who, in addition to being a security officer, is a very well-known public figure in the Jewish community in Hebron, who works for the people of Israel and the Land of Israel.".

At the end of his letter, lawyer Ben Gvir demands compensation of one hundred thousand NIS as well as the publication of an apology. Ben Gvir made it clear that if Serena does not act as required, a defamation lawsuit will be filed against him.
