Ponevezh: There is a decision in the private inheritance battle between the two brothers-in-law

Between the two brothers-in-law, Rabbi Eliezer Kahneman and Rabbi Shmuel Markowitz, an inheritance battle broke out over the private assets bequeathed by their father. Tonight, the arbitrator, Rabbi Avraham Baruch Rosenberger of Monsey, decided between the parties.

The ruling of the arbitrator, Rabbi Avraham Baruch Rosenberger of Monsey, regarding the inherited assets left behind by the president of the Ponevezh Yeshiva, Rabbi Avraham Kahneman, was sent tonight to the parties - Rabbi Eliezer Kahneman and his brother-in-law, Rabbi Shmuel Markowitz.

These are assets that Rabbi Kahneman left to his family, regardless of ownership of the yeshiva – which is being discussed by the Dayan Garach Zimbalist.

In the month of Tevet, the parties – the Gaon Rabbi Eliezer Kahneman and his brother-in-law, the Gaon Rabbi Shmuel Markowitz, met to discuss the family dispute. The president of the yeshiva, Rabbi Avraham Kahneman zt"l, the father of the Gra"a, and the father-in-law of the Gra"sh Markowitz, who was the owner of the properties and the yeshiva, wrote in his will that 60% of his assets would be transferred to his son and 40% to his daughter, Rebbetzin Tzipora Markowitz. Rabbi Eliezer Kahneman is interested in realizing his assets and selling some of them.

About a year ago, the Gra"a Kahneman sold two plots of land from the inheritance properties on 9 Dessler Street and on Admor Magur Street in Bnei Brak, but in the midst of the sale process, he encountered opposition from the buyers, due to claims by Rebbetzin Tzipora Markowitz about her partial ownership of the properties that were about to be sold. The Gra"a Kahneman claimed that despite his father's will, which grants 40 percent to his sister, their mother - Rebbetzin Rivka Kahneman - decided to cancel the division and give her son 100% of the inheritance.

The purchasers of the land, businessman Governor Elish Englander and Satmar institutions, demanded a halachic ruling to prevent future problems.

The parties signed an arbitration deed - for all inherited assets, including the money in bank accounts and additional land in Bnei Brak, such as land on Dessler Street and the corner of Wasserman Street that has not yet been sold - with the rabbi, Rabbi Avraham Baruch Rosenberger of Monsey, who came to Israel as an agreed arbitrator.

The parties met to discuss the matter before him, at the Kfar Maccabiah Hotel in Ramat Gan. The Gra"a Kahneman was represented by the rabbinical advocate Rabbi Binyamin Kuperman, rabbi of the Great Synagogue in Ramat Gan. The Gra"a Markowitz was represented by the rabbinical advocate Rabbi Mordechai Stern, secretary of the Council of Torah Sages of Agudat Israel. Since the process of selling the land was in full swing, the buyers placed the money in the hands of a trustee until the dayan's decision.

Tonight, as mentioned, the judge issued his ruling, in which he ruled that with regard to the lands that have already been sold in the past - the sale is valid and valid, and the money that has already been paid to the Igra Kahneman will be his. The funds deposited in the banks and the lands that have not yet been sold will be divided 60% to the son and 40% to the daughter.

The decision affects the land on Dessler Street, corner of Wasserman Street, and many other buildings and apartments. Regarding the millions of dollars deposited with a trustee from the land sale business, the Dayan Grav Rosenberger will make a decision in the future, how much will be transferred and to whom.
