The murderer of the eleven-year-old girl will not receive a retrial, Baltimore City Court ruled last Thursday.
The murderer, Steven Young, attempted to appeal his imprisonment and request a retrial based on a precedent from early 2012, in which a 1980 ruling was overturned by the state's Supreme Court and dozens of convicted criminals were released.
But in his ruling, Baltimore District Judge Edward Hagedorn wrote that the jury in Young's trial was properly instructed on the verdict and the way to reach the decision, and there was no reason to disqualify it.
Erica Jessoter, Young's defense attorney, stated that he would appeal the court's decision.
Esther Leibowitz, the late, disappeared on Tishrei 17, 5730 (September 29, 1969), after walking down Park Heights Avenue in the city. After disappearing for two days, her body was found in a ditch about half a kilometer from her home. She had been hit in the head 17 times and authorities also estimated that she had been seriously assaulted.
The young man confessed to investigators that he was the one who killed the girl. In his defense, he claimed temporary insanity.
