
High Court judges ruled today (Tuesday) that the work of the Advisory Committee for Appointments to Senior Positions, on the appointment of Major General Roman Gofman as head of the Mossad, "was flawed.".
According to the decision of the judges - Dafna Barak-Erez, Ofer Grosskopf and Alex Stein - the deficiencies in the committee's work were manifested, among other things, in the lack of disclosure of relevant documents from real time and in the absence of direct testimony from parties involved in the matter.
The decision was made in the context of two petitions filed with the court on the subject.
The High Court of Justice ruled that it is appropriate for the advisory committee to complete the examination process it conducted and submit an up-to-date and reasoned opinion to the court. To this end, the judges ordered the committee to hear statements from petitioner Uri Al-Makiis, as well as from Brigadier General G. regarding the affidavit he submitted, including the appendix attached to it.
The judges emphasized in their decision that after hearing this testimony, Major General Roman Goffman will be given an opportunity to complete his statement before the committee members.
It was also determined that the committee may, at its sole discretion, summon any other necessary party to complete the examination.
""To avoid any doubt, these matters are intended to hold a hearing in the committee in accordance with the usual procedures followed therein; and it is hereby clarified that those concerned will appear before it and answer its questions in person, without their attorneys," the High Court judges ruled.
Given the short remaining timeframe, the judges have set clear deadlines for the advisory committee to continue its work and update the court. The committee is required to update the judges by May 21 at 12:00 whether it will act in accordance with the established outline.
After the aforementioned updates are submitted, the Supreme Court will decide on the continued legal handling of the case.
