
The Supreme Court, sitting as the High Court of Justice, this morning (Thursday) considered an expanded panel of seven judges on petitions demanding the establishment of a state commission of inquiry to examine the events of the October Sabbatical and the 'Iron Swords' War.
The discussion is expected to take place without an audience present.
The judges who will decide the petitions are the Deputy President of the Supreme Court, Noam Solberg, David Mintz, Yael Wilner, Ofer Grosskopf, Alex Stein, Khaled Kabub, and Yechiel Kasher.
A limited number of bereaved families participated in the discussion: Itzik Buntzel, Itzik Pitousi, Eyal Eshel, and Yihar Shai.
Knesset members Tali Gottlieb and Ariel Kellner are participating in the discussion.
The judges will be required to decide whether to turn the temporary order they issued to establish a state investigation committee into an absolute order.
The government's position, represented separately from the Legal Advisor to the Government through a private attorney, is that the authority to establish a state commission of inquiry lies solely with it.
She claims that judicial intervention in the matter would constitute a violation of the principle of separation of powers and would even set a precedent. "Such an extreme act has no precedent," her statement said.
Outside the courthouse, a confrontation broke out between representatives of the petitioners and those opposed to the establishment of a state investigation committee.
