
The High Court of Justice ruled this evening (Sunday) that the legal advisor to the Ministry of Justice, Attorney Yael Kotik, must explain within a week to which element in the Prosecutor's Office the investigation file should be transferred, given the fact that it has ended.
The decision was made in a petition that demanded a conditional order be issued to Attorney Kotik, demanding that he explain why the case should not be transferred to the Attorney General in light of the findings of the investigation.
In its order, the High Court expressed agreement that the case should reach the Attorney General's Office.
Attorney Kotik will have to inform the prosecutor's office who she believes should handle the case.
Last week, Attorney Kotik demanded that the police hand over additional investigative materials to her, in order to rule on the question of Gali Baharav-Miara's conflict of interest.
The purpose of transferring the materials is to enable the advancement of the decision-making process on the matter, in light of the completion of the police work on the case.
