The Jerusalem Magistrate's Court ruled that an Arab who humiliated an ultra-Orthodox man in Jerusalem's Old City four years ago and splashed him with water from a watering hose will be convicted of the crime of racially motivated assault.

After the incident, the Jew filed a police complaint, but the case was closed.

''Honenu' filed an appeal demanding that the case be reopened and waged a legal battle, which resulted in the Arab being convicted. At the same time, Attorney Bleicher filed a civil lawsuit against the Arab.

The attack occurred about four years ago, late at night. The Haredi was on his way to prayer in the Majlis Gate area of Jerusalem, wearing distinctive Haredi clothing. As he passed near the place where the Arab attacker was, who was busy at the time with his friend washing a scooter using a water hose, the attacker began to spray water in his direction using the hose.

The complaint filed by Honenu describes how the Arab repeatedly sprayed water on the Jew who tried to escape from him: "When the plaintiff was close enough to where the two were standing, the defendant began spraying water from the hose, pointing the hose directly at the plaintiff. At this point, the water was not directed at the scooter at all.

""The plaintiff, who got wet from the water, tried to avoid the stream of water as he walked. However, the defendant continued to move around the scooter, with the hose constantly directed so that the stream of water would be towards the plaintiff. Sometimes the water also hit the scooter and sometimes it did not. The plaintiff tried to hide behind the corner of one of the nearby buildings. However, the defendant stopped the stream of water, walked towards the other side of the scooter and began spraying water again. The entire time, the stream of water was directed by the defendant towards the plaintiff.".

Attorney Bleicher: "This is an ugly anti-Semitic act aimed at humiliating and harming a Jew in Jerusalem - the capital of the Jewish people. We fought throughout the time for the incident to be handled in criminal proceedings and through civil litigation.".

""It is clear to us that if such a humiliating event is passed over in silence as if it were nothing more than a prank, the next time it will meet us with anti-Semitic incidents with, God forbid, psychological harm. Such incidents must be dealt with with zero tolerance and eradicated from the root before they develop into more monstrous proportions.".

""We congratulate Judge Bealin for the unequivocal ruling that considers the incident a racist act, and we expect severe punishment for the perpetrator.".
