The court rejected a petition against the registry of associations that approved proper management for 'independent education'"

The Jerusalem District Court, sitting as an administrative court, rejected a petition filed against the registry of associations - and the proper management approval for the "Independent Education Center" association for 2025 remained valid.

The petition submitted claims that the Independent Education Association is in a significant financial deficit and that there are deficiencies in its conduct, which justify the opening of an inspection and investigation by the Registrar of Associations prior to granting approval.

The petitioners referred, among other things, to a letter from the Accountant General from the beginning of 2024, in which he noted deficiencies in the organization's financial system and its supervision.

The court accepted the position of the Registrar of Associations, which was presented by Attorney Meni Menachem of the Jerusalem District Attorney's Office, and ruled that there was no reason to interfere with the Registrar's discretion.

The ruling noted that the Accountant General, who had previously pointed out deficiencies, updated the registry in September 2024 that he did not have concrete information that would prevent the approval from being granted and that he was working to promote oversight and control measures and change the organization's budgeting method.

The court gave great weight to this position, emphasizing that the registrar is entitled to rely on the professional bodies responsible for budgetary audit and supervision. It was further determined that, in the opinion of the professional bodies, the association is not in a significant financial deficit and that in any case, the mere existence of a financial deficit does not, in itself, require the denial of proper management approval.

In accordance with the ruling, in its decision on registration, it took into account broad public considerations, including the importance of the activities of the association, which operates hundreds of educational institutions in which approximately 130,000 students study and approximately 10,000 employees are employed.

The summary of the ruling stated: "Since this decision is at the core of the professional judgment of the Registrar and is based on a proper foundation and an examination of all the considerations required for the matter, no defect can be found in it and there is no reason for judicial intervention in it." The prosecutor's office stated: "The ruling confirms the correctness of the administrative operation of the Registry of Nonprofits and its discretion in the control processes over bodies supported by the state budget. The court determined that the decision to grant proper management approval to the 'Independent Education Center' non-profit was lawfully made, after examining the relevant data and consulting with the authorized professional bodies.".
