
The District Court rejected this evening (Monday) the appeal filed by Yifat Tomer Yerushalmi for the extension of her detention by three days.
Tomer Yerushalmi requested, through her lawyers, to be released to house arrest. Her request was denied, with it being determined that "there is reasonable suspicion of obstruction of justice.".
The defense team argued that one of the grounds for arrest established by the court was 'dangerousness,' even though the state did not allege this against Tomer Yerushalmi. "This appeal is filed due to a clear error in the lower court's decision which ordered her arrest on the grounds of 'dangerousness,' even though the respondent did not at all claim that she posed a danger," her lawyers wrote.
The detention of the former Chief Military Prosecutor, Col. Matan Solomesh, has also been extended. The two are suspected of committing serious offenses: abuse of office, obstruction of justice, fraud and breach of trust, and disclosure of official information by a public servant.
The police admitted in the hearing that Tomer Yerushalmi has not yet been questioned and that the assessment is growing that when she disappeared for hours yesterday in the Tel Aviv Cliff Beach area, she did not try to end her life - but rather wanted to get rid of her cell phone.
According to a report on Channel 12, in the initial interrogation transcript, Tomer Yerushalmi was asked: "Where did you disappear to for 3 hours? An entire country is looking for you, your family is crying with worry." She replied: "I'm confused, I don't know what's happening to me.".
She added, "Someone I ran into nearby gave me his phone number to call my husband.".
When asked where her personal device was, she replied: "I have no idea, maybe I dropped it in the sea - I really don't remember.".
The investigator asked: "Did you throw him into the sea?" - and she responded, "I don't remember.".
According to a report in Kan News, a suspicion was examined that the promotion of a senior official in the Military Prosecutor's Office was delayed to prevent the disclosure of the Yemeni field leak affair.
The senior official, the spokesperson for the Military Attorney's Office, was the one who revealed the obstruction of the investigation by the Chief Military Attorney.
According to the suspicion examined, the officer's promotion was deliberately delayed in order to prevent her from taking a polygraph test. As part of the Shin Bet test, which she eventually passed, the senior officer spoke about Tomer Yerushalmi's instructions to leak the video from "Yemen Field," as well as the obstruction of the investigation.
It was also reported this evening on 'Kan News' that Justice Minister Yariv Levin met with the acting Civil Service Commissioner in search of a civil servant who would handle the investigation of the MPA in place of Legal Advisor to the Government Gali Baharav Mayara.
The legal advice insists that the government will not be the one to appoint a prosecutor for the case, even if the Barhav Maira itself may ultimately decide not to handle the case.
These fundamental differences of opinion may reach a decision by the High Court.
