בביהמ”ש העליון ברומניה יתקיים מחר (שלישי) בבוקר דיון קריטי  למניעת הסגרתו של רומן (סוובן) דורפמן, יהודי דתי בן 38 מבני ברק,  העצור מזה 3 חודשים ברומניה, בהתאם לצו מעצר בינ”ל שהוציא האינטרפול לבקשת בלארוסיה, המבקשת את הסגרתו. לפי הערכות, הוא צפוי שם למאסר של 10 שנים.

דורפמן נעצר לפני כחודשיים ברומניה, כשהיה  בדרכו להלוויית אמו שנפטרה בקישינב שבמולדובה.

בלארוס היא מדינה בעלת סטנדרטים מהנמוכים בעולם בכל הקשור לזכויות אדם. העבירה בה מואשם דורפמן הינה כלכלית פעוטה, שכן בהתאם לכתב האישום הבלארוסי דורפמן אירגן מופע של מרוצי אופנועים, המופע בוטל – והוא מואשם כי לכאורה לא החזיר סכום של 15,500 אירו למי ששילמו עבור כרטיסים.

במהלך הדיונים המשפטיים, ביקש השופט הרומני לקבל חוות דעת ממשרדי החוץ והמשפטים הרומניים, בקשר למצב זכויות האדם בבלארוס.

כצפוי, המשרדים הללו הביעו דעתם כי מצב זכויות האדם בבלארוס הינו מתחת לכל אמות מידה בינ”ל, ומהגרועות בעולם. בצורה מפתיעה, החליט השופט לפני 3 שבועות להסגירו לבלארוס.

על החלטת השופט הוגש ערעור לבית משפט העליון בבוקרשט.

הדיון הקבע למחר 3.5.22 בשעה 9:00.

עו”ד מרדכי ציבין, המטפל בתיק יחד עם עו”ד מקומיים, אומר כי הוא מצר על כך שבקשתו מביהמ”ש המחוזי לבטל את ההסגרה נכשלה – והדבר בא לו בהפתעה מוחלטת. “מניסיוני בתיקי אינטרפול אחרים ובקשות למעצר בינ”ל, טרם נתקלתי בתופעה כזו של אי התחשבות מוחלטת במצב זכויות אדם, וחוסר אפשרות למשפט הוגן במדינה אליה מתבקשת ההסגרה”.

בעניין זה מדגיש ציבין כי לפני כשנה נעצר מרשו בהונגריה, שם ביהמ”ש החליט לא להסגירו לבלארוס בשל מצב זכויות האדם. “הפלא הגדול הוא שהונגריה הנחשבת ל’כבשה השחורה’ באירופה, ימין קיצוני ואלמנטים נוספים של שלטון לא דמוקרטי, החליטה לא להסגירו, ואילו רומניה, החברה באיחוד האירופאי ומציגה עצמה כמדינה דמוקרטית בעלת זכויות אדם, דווקא היא שהחליטה להסגיר”.

עו”ד ציבין מוסיף: “התמיהה על ההחלטה להסגיר מתגברת אם לוקחים בחשבון את מעורבותה של בלארוס במלחמה באוקראינה”. לדבריו, בלארוס נגועה באנטישמיות, וכי היו לא מעט-אימרות אנטי יהודיות, אשר נאמרו על ידי הנשיא לוקשנקו.

ציבין אומר, כי הוא מקווה שביהמ”ש העליון בבוקרשט יחליט מחר להפוך את ההחלטה הקודמת של ביהמ”ש המחוזי ויחליט שלא להסגיר ברונפמן לבלארוס.

עו”ד ציבין מדגיש, כי” עבור המאבק למניעת ההסגרה, אין צורך בכספי תרומות, וגם לא יהיה צורך”.

A critical hearing tomorrow in the Romanian Supreme Court to prevent the extradition of Roman (Swabian) Dorfman, who has been detained for three months in Romania, in accordance with an international arrest warrant issued by Interpol at the request of Belarus requesting his extradition to it.
The offense with which Dorfman is charged is a minor economic offense, as according to the Belarusian indictment Dorfman organized a show of motorcycle racing, the show was canceled and he is accused of allegedly not returning a sum of 15,500 euros to those who paid for the tickets.
During the legal hearings, the Romanian judge asked for an opinion from the Romanian Ministry of Foreign Affairs and Justice regarding the human rights situation in Belarus. As expected the above ministries expressed their opinion that the human rights situation in Belarus is below all international standards, and one of the worst in the world. Surprisingly, the judge decided three weeks ago to extradite him to Belarus.
The judge’s decision was appealed to the Supreme Court in Bucharest. The hearing is scheduled for tomorrow 3.5.22 at 9:00.
Advocate Mordechai Tzivin, who is handling the case together with local attorneys, says that he regrets that his request from the district court to reject the extradition request failed and this came as a complete surprise to him.
“From my experience in other Interpol cases and requests for international detention, I have never encountered such a phenomenon of complete disregard for the human rights situation, and the impossibility of a fair trial in the country to which extradition is requested.”
In this regard, Tzivin emphasizes that about a year ago his client was arrested in Hungary because of the same extradition request, where the court decided not to extradite to Belarus due to the human rights situation.
“The great wonder is that Hungary, which is considered the ‘black sheep’ in Europe, extreme right and other elements of undemocratic regim, has decided not to extradite while Romania, which is a member of the European Union and presents itself as a democratic state with human rights, decided to extradite Roman.”
tzivin further says “the perplexity of the decision to extradite increases if one takes into account Belarus’ involvement in the war in Ukraine.”
Tzivin claims that Belarus is infected with anti-Semitism, and that there were quite a few anti-Jewish statements made by President Lukashenko.
“The argument that Jews are imprisoned for anti-Semitism, in the vast majority of cases it has nothing to rely on, and detached from reality, the fact that the Gentiles hate the Jews does not mean that the Jews do not like money.”
The common use of the term anti-Semitism cheapens the expression and is carried by the people as a mere cliché. That is not the case with Belarus, where anti-Semitism, mainly in prisons, is sharply and openly present. ”
Tzivin hopes the Supreme Court in Bucharest will decide tomorrow to reverse the previous decision of the district court and decide not to extradite his client to Belarus.
