אז מה לרמטכ”ל של גרמניה ולפרויקט ‘חוכמת חיים’ של צעירי חב”ד?

כשעורך הדין היהודי הסביר לרמטכ”ל הגרמני על הערכה החב”דית ללימוד ערכי המוסר: עו”ד מרדכי ציבין הוזמן רשמית ל’כנס ברלין לבטחון’ – הקונגרס ה-15 לביטחון והגנה של אירופה (Berlin Security Conference, the 25th Congress on European Security and Defense), במהלכו הסביר לרמטכ”ל הגרמני מה היא ערכת לימוד ‘אחים לצרה’ ונושאים נוספים הרלבנטיים לצבא, היוצאים לאור על ידי פרויקט ‘חכמת חיים’,  מודל לימודי שפותח על ידי צעירי חב”ד בישראל, להכרת עולם התרבות והרוח היהודי לאורך הדורות.

המודל מבוסס על משחקי דילמות מוסריות וחברתיות הלקוחות מתוך החיים, החל משאלות אקטואליות המטרידות את מחשבתנו וכלה בבעיות מוסר המלוות את החיים מסביב.

הרמטכ”ל הגרמני גילה עניין רב והמליץ להעביר הערכות לצבא הגרמני.

 בכנס השתתפו בין היתר רמטכ”ל צבא גרמניה ורמטכ”ל צבא צרפת, בכירים מהאיחוד האירופאי ומשירותים חשאיים אירופאיים והאלופים במיל’ עמוס מלכא – ראש אמ”ן לשעבר, איתן בן אליהו – מפקד חיל האוויר לשעבר, וידידיה יערי מפקד חיל הים לשעבר, כמו גם נציגים בכירים של חברות ישראליות העוסקות בענייני בטחון ומניעת טרור.

בפאנל הישראלי של הכנס אמר עו”ד ציבין: “נאמרו כאן דברים בקשר למלחמה בטרור אשר מדינות אירופה משקיעות לצורך כך למעלה מ-2.5 מיליארד דולר בשנה. אני מציע דרך נוספת להילחם בטרור, דרך אשר כבר ניסינו בעבר בבלגיה בפני התובע הכללי, על מנת להוציא צווי מעצר נגד בכירים בחמאס, תלונה ראשונה מסוגה לבית הדין הבינלאומי הפלילי בהאג נגד אבו מאזן ובכירים ברשות הפלשתינית ובחמאס, וכן תביעה לאיחוד האירופאי להפסיק תמיכתו הכספית בעזה המוזרמת לאירוגני טרור – ולסייע במיגון אזרחי האיחוד המתגוררים בישוביי עוטף עזה. דרך זו זולה יותר ולפעמים אף יותר אפקיטבית.

“כוונתי לשימוש במשפט הבינלאומי כמכשיר נגד טרור, גם אם לעתים הליך משפטי כזה או אחר נכשל, הרי שדעת הקהל מושפעת מאוד מכך והמודעות לטרור גוברת. מערכות המשפט האירופאיות מוכרחות להתעורר ולהבין כי עליהם לקחת חלק במאבק הבינלאומי בטרור. מצופה ממערכות החוק האירופאיות להוציא לפועל את כוח השיפוט שלהם ולתבוע את ראשי כל ארגוני הטרור האיסלאמיים.

“ישנם פרוצדורות חוקיות רבות בהם ניתן לעשות שימוש, כולל האפשרות ליישום את עיקרון סמכות השיפוט האוניברסלית. לפני יותר משש שנים אספנו, עו”ד אורי יבלונקה ואנוכי, הררי ראיות כנגד עשרה טרוריסטים חברי חמאס מסוכנים ביותר, והגשנו תלונה פלילית מבוססת ביותר לתובע הכללי הבלגי לחוק הומאניטארי.

“ביקשנו ממנו כי יפעיל סמכות שיפוט פלילית על עשרות מקרים בהם רקטות נורו מעזה על ידי החמאס, לתוך יישובים וכפרים ישראלים. עשרות אזרחים בלגים אשר גרים באזורים אלה נפגעו מפשעים בינלאומיים אכזריים אלה.

“לרוע המזל, התובע הבלגי לא עשה דבר על מנת לקדם חקירה רשמית בנושא. כעת, טרור הפצצות האיסלאמי הגיע לאירופה ובעיקר לבלגיה וצרפת. עכשיו אלו שנרצחים ונפגעים אינם אזרחי בלגיה בלבד אלא גם תושביה. אנו מפצירים במערכות המשפט בגרמניה וברחבי האיחוד האירופי להתחיל להעמיד לדין טרוריסטים איסלמיים כבר עכשיו, כאשר הם עדיין בבסיסיהם המזרח תיכוניים, ולא לחכות עד שהם יגיעו לליבה של אירופה”.

Adv. Mordechai Tzivin was officially invited to the Berlin Security Conference, the 25th Congress on European Security and Defense, which was participated, among others, by the German army Chief of Staff and the French army Chief of Staff, by senior officials of the EU and of European secret services, and by former Israeli Major Generals – Amos Malka, former head of the Directorate of Military Intelligence; Eitan Ben Eliyahu, former Israeli Air Force Commander; Yedidya Ya’ari, Israeli Navy Commander, and by other senior representatives of Israeli companies in the defense and terror prevention business

At the conference, Adv. Mordechai Tzivin explained to the German Chief of Staff the content of the “Achim Le’tzara” (Partners in Misfortune) learning pamphlet, and about other maters relevant to the army, published by the “Chochmat Chaim” (Wisdom of life) project which is a learning model developed by the Chabad head organization in Israel, in order to spread the knowledge of the world of Jewish culture and spirit through the ages. The model is based on moral and social dilemmas taken from life, beginning with contemporary questions troubling our minds, through to moral questions regarding life around us. The German Chief of Staff showed great interest, and recommended that the learning pamphlets be handed over to the German army

In the Israeli panel at the conference, Adv. Tzivin said: “There were things said here regarding the war on terror, in which the European countries are investing more than 2.5 billion dollars a year. I suggest a different way to fight terror, a way we already tried in Belgium where we requested that the Attorney General issue arrest warrants against Hamas senior officials, by a first of its kind complaint to the International Criminal Court in the Hague against Abu Mazen and other senior officials of Fatah and Hamas, and also by a demand to the EU to stop its financial support in Gaza, money which is transferred to terrorist organizations, and to aid in protection of EU citizens living in the Gaza envelope area. This way is cheaper and sometimes more effective. Using the international law to fight terror, even if sometimes one or another legal procedure fails, has great influence on public opinion and the awareness to terrorism grows

The European justice systems must wake up and realize that they should take part in the international fight against terrorism. The European legal systems are expected to assert their criminal jurisdiction and prosecute the heads of all Islamic terror organizations. There are many legal procedures they could use, including the implementation of the principle of universal jurisdiction

More than six years ago, Adv. Uri Yablonka and myself gathered mountains of evidence against 10 of the most dangerous Hamas terrorists, and we filed a well-based criminal complaint to the Belgium General prosecutor for humanitarian law. We requested that he apply criminal jurisdiction over dozens of cases in which rockets were fired from Gaza by Hamas on Israeli towns and villages. Dozens of Belgium citizens who live in these areas were hurt by these vicious international crimes. Unfortunately, the Belgian prosecutor did not do anything to promote an official investigation in this matter. Currently, the Islamic terrorist bombings have reached Europe – and mainly Belgium and France. Now those murdered and injured are not only Belgian citizens, but they are also its residents

We urge the justice systems in Germany and across the EU, to start indicting Islamist terrorists immediately, when they are still in their middle-eastern bases, and to not wait until they reach the heart of Europe”
