4 חרדים שתבעו את חמאס בבלגיה: “למה גוררים רגליים?”

על רקע מתקפת הטרור בפריז: בשבוע שעבר פנה עו”ד מרדכי ציבין לתובע הפדרלי הבלגי, בבקשה לזרז מתן החלטה בתלונה שהגיש בבלגיה נגד בכירי החמאס בשם ארבעה ישראלים, חרדים תושבי אשדוד המחזיקים גם באזרחות בלגית, אשר נפגעו במהלך מבצע ‘עופרת יצוקה’.

עקב התלונה, שהוגשה בדצמבר 2009 ובה התבקשה משטרת בלגיה להוציא צווי מעצר נגד בכירים בחמאס, נפתחה חקירה, במהלכה הגיעו המתלוננים לבלגיה, לפי דרישת התובע, ומסרו עדותם בפני שופט חוקר.

כמו כן הומצאו לתביעה הבלגית, על פי דרישתה, מסמכים רפואיים לביסוס התלונה.

בתלונה מתבקשת משטרת בלגיה להוציא צווי מעצר בין היתר נגד איסמעיל האנייה, מוחמד דאף, חאלד משעל ועוד בכירים של ארגון הטרור חמאס. כזכור, פלסטינים הגישו באירופה תלונות דומות נגד ציפי לבני, אלוף (מיל.) דורון אלמוג ועוד.

בפנייתו לתובע הבלגי, מדגיש עו”ד ציבין כי חלפו שש שנים מאז הגשת התלונה והטיפול בתביעה בקושי התקדם, למרות שלקוחותיו מילאו אחר כל דרישות התביעה הבלגית.

עתה, לנוכח הטרור המשתולל באירופה, כתב ציבין, כי יש מקום לזרז את מתן ההחלטה בתלונה לא רק לתועלת המתלוננים, אלא גם לתועלת הציבור בבלגיה, כמו גם בכל אירופה.

עו”ד ציבין אומר: “העיכוב וגרירת הרגליים בטיפול בתלונה ובמתן החלטה הוא עוול כלפי לקוחותיי ולא פחות, כלפי הציבור באירופה ובצרפת ובבלגיה בעיקר. ההתנהלות הזו היתה לרועץ וחבל, משום שהיא עשויה היתה להיות הרתעה מסויימת כלפי טרוריסטים”.

ציבין, עו”ד הידוע כבעל קשרים מסועפים ברחבי העולם, מהם מסתוריים ובלתי שגרתיים, היה הישראלי הראשון שהגיש תלונה לבית המשפט הפלילי הבינלאומי בהאג, נגד אבו מאזן ובכירים נוספים ברשות הפלשתינית ובחמאס.

4 Ultra-Orthodox Jews prosecuting Hamas in Belgium:

 “Why is the case scuffed?”

Four Ultra-Orthodox Jews from Ashdod, who have Belgian citizenship, submitted a claim 6 years ago in Belgium: to put out   arrest warrants against seniors in Hamas • “the delay and scuffing in dealing with the complaint has become an obstacle and it is a shame, for it could have deterred terrorists”

Regarding the terror attack in Paris: Last week attorney Mordechai Tzivin addressed the Belgian Federal Prosecutor in a request to expedite the giving of a decision regarding the complaint that was submitted in Belgium against senior Hamas members on behalf of four Israelis, Ultra-Orthodox Jews residents of Ashdod who hold Belgian citizenship, that were injured during operation Cast Lead.

As a result of the complaint, that was submitted in December 2009 and In which the Belgian police were asked to put out arrest warrants against seniors in Hamas, an investigation was opened, during which the complainants came to Belgium, according to the prosecutors request, and gave their testimony before an investigative judge.

 In addition, the Belgian prosecutor was presented, at its request, medical documents to establish the complaint.

In the complaint, the Belgium police is requested to issue warrant arrests also against Ismail Haniyeh, Mohammed Duff, Mashaal and other seniors of Hamas terrorist organization. Recall, the Palestinians have filed similar complaints in Europe against Tzipi Livni, Major General (res.) Doron Almog and more.

In his letter to the Belgian Federal Prosecutor,  attorney Tzivin emphasizes that six years have passed since the filing of the complaint and the investigation barely moved, despite his clients compliance with all the requirements of the Belgian prosecution.

Now, in light of the rampant terrorism in Europe, wrote Tzivin, that there is reason to expedite the decision in the complaint not only for the benefit of the complainants, but also for the benefit of the people of Belgium, as well as throughout Europe.

Attorney Tzivin says: “The delay and foot-dragging in dealing with the complaint and issuing a decision is injustice to my clients, no less, to the people in Europe and particularly in France and Belgium. This behavior was an obstacle and a shame, because it could have been a certain deterrent against terrorists “.

Tzivin, is a lawyer known for his connections proliferating throughout the world, some of them are mysterious and unconventional, he was the first Israeli to file a complaint with the International Criminal Court in The Hague against Abu Mazen and other seniors of the Palestinian Authority and Hamas.
