During the High Court hearing today (Tuesday) on the petitions for the appointment of Major General David Zini as head of the Shin Bet, an unusual confrontation was observed between Judge Yitzhak Amit and two of the judges on the panel - Alex Stein and Gila Kanfei Steinitz.<\/p>\n\n\n\n

During the hearing, the attorneys for all the respondents, including the attorneys representing the government, the prosecution, and the various petitioners, addressed the three judges on the panel and presented their arguments.<\/p>\n\n\n\n

The three judges choose to be involved in the hearing, making it difficult for the lawyers and their arguments throughout the hearing. <\/p>\n\n\n\n

For example, Judge Amit refers to the investigation into the Qatar affair and its connection to the appointment of the head of the Shin Bet - and said: "We are talking about a sensitive investigation that concerns the close associates and the holy of holies of the Prime Minister's Office. There is an argument that I wish it would be a lie that there was infiltration by another party, and it doesn't matter whether it is Switzerland or Qatar.".<\/p>\n\n\n\n

If this isn't a conflict of interest, I don't know what is a conflict of interest," Amit continued, "The Prime Minister has tied himself up, when he says this is a hunting expedition and nothing will come of it - he is telling the investigators what the result should be, that nothing will happen. And that is problematic. This is a problematic situation that they are trying to neutralize.".<\/p>\n\n\n\n

However, in contrast to his position, the position of Justices Stein and Kanfi-Steinitz was different. <\/p>\n\n\n\n

For example, when the representative of the prosecution, Attorney Neta Oren, presented her arguments, Judge Stein turned to her: "I have a difficulty with your position, because I read the law, which is clear. There is a settled law that says that in this situation there is no escape. A person with a conflict of interests will exercise his authority.". <\/p>\n\n\n\n

With these statements, Stein criticizes the position of the Attorney General's Office and the Attorney General on the issue.<\/p>\n\n\n\n

Judge Kanfi-Steinitz even added to Stein's words and amplified them, when she also addressed Oren: "There is a lengthy discussion here on the question of conflict of interest throughout the entire opinion of the Legal Advisor to the Government. We are dealing with a law according to which the legislator found the Prime Minister to be the appropriate person to appoint the head of the Shin Bet. All of these considerations have no expression in the legal advisor's opinion."\"<\/p>\n\n\n\n

The discussion between Attorney Neta Oren, Deputy Director of the High Court Department, and the judges continued as she claimed: "The Prime Minister has put us in a difficult situation. The contamination of the procedure by the Prime Minister, who has a conflict of interest. We could not have chosen a better alternative.".<\/p>\n\n\n\n

However, she admitted: "It's not certain that the opinion would have been different if Netanyahu had not rushed to announce Zini's appointment.".<\/p>\n\n\n\n

Judge Amit: "This is not a long-standing conflict of interest, a focused conflict of interest, not too broad, on a specific issue.".<\/p>\n\n\n\n

After Amit's remarks, Judge Kanfi Steinitz responded: "But you are asking for a complete disqualification. We are dealing with a conflict of interest at a time when the head of the Shin Bet needs to be chosen - an appointment that will affect the next 5 years. There is a disqualification here of exercising authority, it is expected to be done sparingly.".<\/p>\n\n\n\n

Afterwards, a dramatic debate broke out in the Supreme Court between the Steinitz and Stein wings and Amit. <\/p>\n\n\n\n

Judge Alex Stein argued: "The prime minister can disagree with the attorney general and think that the law simply states that he appoints the head of the Shin Bet.". <\/p>\n\n\n\n

To this, Judge Amit responded: "I disagree. It was determined that the Attorney General is the interpreter of the law.".<\/p>\n\n\n\n

Stein responded: "That's what we're here for. I read the law and it's clear. I have a hard time with things outside the law.".<\/p>\n\n\n\n

Judge Stein later directly criticized the position of the legal advisor to the government, in front of the representative of the attorney general at the hearing, and said: "My lady is also subject to the law. How does the attorney general's directive against Netanyahu's involvement stand in relation to the Shin Bet law?"\"<\/p>\n\n\n\n

He added: "There is a special weight in the law that should be given to the appointment of the prime minister, and there is a ruling by President Barak that allows an appointment in a situation of conflict of interest and minimizes the damage" - but Amit responded: "This is a doctrine for essential cases and it is said that one should be careful about expanding it.". <\/p>\n\n\n\n

Judge Stein concluded his remarks by saying: "Apparently the court is divided on what constitutes essential cases.".<\/p>\n\n\n\n

Stein continued, pressing: "Does my lady agree with the claim that the head of the Shin Bet decides for himself whether to deal with this or that case?" The representative of the attorney general replied: "Yes.".<\/p>\n\n\n\n

Stein wondered: "Well, if the prime minister agrees with Major General Zini in a conflict of interest arrangement that he will not deal with the Qatargate case - what's the problem?". <\/p>\n\n\n\n

The Ombudsman's representative explained: "The Prime Minister will not determine what the conflict of interest arrangement is.".<\/p>\n\n\n\n

Later, when the representative of the Attorney General's Office said: "There are at least two ministers who can have the authority (to appoint the head of the Shin Bet in place of Netanyahu), the Minister of Justice and..." -
