A chef at a successful restaurant in Jerusalem was injured during one of the restaurant's busiest evenings. While working that evening, the chef lifted a heavy can of oil, which slipped from his hand and ruptured a tendon in his right shoulder - his dominant hand.<\/p>\n\n\n\n
Despite the intense pain, the chef completed his shift and only at the end did he seek medical treatment, where it was discovered that he was suffering from a torn shoulder muscle.<\/p>\n\n\n\n
According to attorney Shiri Alon, who represents the chef, he was very afraid of having surgery and therefore underwent various rehabilitation treatments, but without sufficient benefit to his condition.<\/p>\n\n\n\n
In his distress, he turned to attorney Shiri Alon, who submitted a request on his behalf to the National Insurance Institute (NII) to recognize the incident as a work-related accident. The incident was indeed recognized as a work-related injury, and the chef was later scheduled for an examination by a medical committee.<\/p>\n\n\n\n
At the committee, the chef described the significant limitations he suffers from, including a limitation in the range of motion of his right shoulder and difficulty lifting heavy objects. An examination conducted by doctors revealed that he suffers from severe limitations in forward lifting and abduction of the hand, and that internal and external rotation movements are limited.<\/p>\n\n\n\n
The medical committee, headed by an orthopedic surgeon, determined that the chef's condition was terminal, and granted him permanent disability at a rate of 15% in accordance with the National Insurance regulations. However, the committee chose not to invoke Regulation 15, which also examines functional limitations beyond medical disability, since it turned out that the chef had returned to his full-time job and there was no decrease in his salary.<\/p>\n\n\n\n
According to Attorney Alon, as part of the procedure with National Insurance, the chef was approved for a temporary monthly allowance, and later he was also granted a one-time benefit in a total amount of more than 100,000 shekels. In total, the chef was compensated with a little more than 150,000 shekels.<\/p>\n\n\n\n
According to Attorney Alon, the mere fact that the chef returned to work does not constitute proof that the accident did not cause damage. He still suffers from pain and limitations that require continued treatment. <\/p>\n\n\n\n
In addition, recognizing the event as a work accident gives the chef the option to return to the National Disability Insurance Fund at any time, if his condition worsens \u2013 and to request an increase in his disability percentage and the benefits he is entitled to from them.<\/p>\n\n\n\n
According to Attorney Alon, in addition to disability grants and ongoing allowances, the chef is entitled to reimbursement of medical expenses and rehabilitation treatments, including physiotherapy and pain relief injections.<\/p>\n\n\n\n
