The construction of the ambitious project was only made possible due to serious corruption by senior public servants in the Beit Shemesh municipality during those years - including Deputy Mayor Moshe Montag, who is accused, among other things, of numerous fraud and breach of trust offenses, city engineer Danny Tzarfati - who is suspected, among other things, of accepting bribes from one of the entrepreneurs, and the legal advisor to the local committee, Motti Berkowitz - who is suspected, among other things, of fraud and breach of trust offenses. The public servants allowed the planning and construction of the project, even though they knew that it was a residential construction, in violation of the law. According to the indictment, the defendants took a plot of land designated for the construction of a 3-story &#039;Institution-Torah Center&#039; for the benefit of the neighborhood&#039;s residents, and through sophisticated fraudulent acts and government corruption, they built &#039;Shikon Yoel&#039; on it: a multi-story construction complex, which includes a 3-story commercial center and 3 towers containing dozens of residential apartments, which were sold at a discounted price to Satmar Hasidic families - while ignoring planning laws and committing serious tax and money laundering offenses.\r\n\r\n<strong>The main defendants in the case are the public employees and the entrepreneurs who led the project:<\/strong>\r\n\r\nPublic servants: Moshe Montag \u2013 Chairman of the Planning and Building Subcommittee, and Deputy Mayor. Danny Tzarfati \u2013 City Engineer. Mordechai Berkowitz \u2013 Attorney General of the Local Committee. The developers who promoted the project between 2016-2018 are: Leib Waldman \u2013 real estate developer and capitalist. Shlomo Eisenstein \u2013 lawyer. The developers who promoted the project between 2010 and 2016 are: Mordechai Koenig \u2013 contractor. Irit Marciano \u2013 lawyer. Michael Ben David \u2013 real estate developer. In addition, the indictment was also filed against additional defendants, including companies associated with the project. The indictment details the offenses across six charges.\r\n\r\n<strong>First charge - divided into two chapters:<\/strong>\r\n\r\n<strong>The first chapter<\/strong> Chronologically recounts the establishment of the Sfat Emet project during the years 2010-2018. The project was founded on the foundations of bribery, fraud, breach of trust, tax offenses, money laundering, and planning and construction offenses. Between 2016-2010, the developers Ben David, Koenig, and Marciano, each according to their share, promoted the establishment of the project, either on their own or through companies they established. In September 2016, the rights to the plot were sold to Waldman, and from that date until the opening of the investigation into the case, Waldman and Eisenstein promoted the project on their own or through companies and associations they established for the Satmar Hasidim. Photo: Haredim 10<\/strong><\/h6>\r\nOriginally, the plot was allocated by Rami to the &#039;Beit Ve&#039;manocha&#039; association, for the purpose of establishing a &#039;Torah Center-Institution&#039;, three stories high, for the benefit of the public. However, at the end of the period, as a result of the offenses committed by the defendants, each according to his share, the plot now has an eight-story building skeleton, intended for a commercial center and 60 apartments, which were sold by Waldman and Eisenstein to various buyers, as residential apartments, without any connection or connection to the &#039;Torah Center-Institution&#039;. The aforementioned dramatic gap, between the original designation of the plot according to the urban planning plan, and the real estate project that was established on it, which includes a commercial center and dozens of residential apartments - was achieved through a long and sophisticated series of acts of fraud and concealment by the defendants, each according to his share, as well as a series of offenses in the areas of planning, construction and taxation - so that the project was built while evading a process to change the plot&#039;s designation, from paying millions of shekels. In this framework, among other things, public employees Montag, Tsrafati and Berkowitz acted with a severe conflict of interest and deviation from the norm, and approved building permits for the project - for the benefit of the developers and at their request - in violation of planning and building laws. Alongside the prohibited and unusual actions that Montag took to promote the project within the framework of his &quot;public hat&quot; as chairman of the local committee and director of the engineering department, Montag helped Waldman and Eisenstein, his close friend, sell the residential apartments in the project, while ensuring that loans were provided to the apartment buyers within the framework of his &quot;private hat&quot; as the CEO of the Central Housing and Urban Development Agency - which deals with providing loans for housing needs in the Haredi sector. During the years 2017-2018, during the construction of the &#039;Sefat Emet&#039; project, Montag Moldman received various benefits, which exacerbated the conflict of interest in which he was, and this was when the project ran into difficulties and Montag was increasingly required to help promote it. In this framework, Waldman donated, among other things, a magnificent ark, worth about a quarter of a million NIS, to the &#039;Mishkan Israel&#039; synagogue in Beit Shemesh, which was established by Montag and others, and is named after Montag&#039;s grandfather. Waldman donated NIS 1 million to build a synagogue in Ramat Beit Shemesh to promote Montag&#039;s mayoral election campaign, and the two tried to jointly promote a construction project on the lands of the Beit Jimal Monastery near Beit Shemesh. In establishing the &#039;Sefat Emet&#039; project, a series of serious offenses were also committed in the areas of planning and construction, while avoiding carrying out a procedure to change the zoning of the plot, paying the full amount required to the authorities for the improvement of the property, and the other requirements and taxes imposed on a developer building a commercial and residential project.\r\n\r\n<strong>The second chapter<\/strong> Describes the many economic crimes committed during the establishment of the &#039;True Language&#039; project. Numerous crimes of evading payment of millions of shekels to the tax authorities, defrauding creditors using front men, and numerous money laundering operations carried out with the &quot;prohibited property&quot; accumulated during the management of the project.\r\n\r\n<strong>Second charge:\u00a0<\/strong>\r\n\r\nDuring the years 2015-2018, Tzarfati maintained a close relationship with a builder named Yitzhak Reber. In this context, Tzarfati received various benefits from Reber from time to time, with the aim of influencing his judgment and enlisting his support in favor of advancing Reber&#039;s and his clients&#039; businesses. Tzarfati was aware that the benefits given and offered to him by Reber were in favor of his action and influence in the framework of his position as city engineer, to advance Reber&#039;s interests. In exchange for the aforementioned benefits, Tzarfati&#039;s door was open to Reber at all times, and he acted favorably towards Reber, by assisting him, or attempting to do so, in handling various matters of Reber&#039;s with the Engineering Department, and personally advancing various planning and construction matters that were in Reber&#039;s care. Reber, for his part, used his special connections with Tzarfati for his personal and business advancement, as a mover in the corridors of the engineering department at the municipality. Tzarfati avoided reporting his personal connection to Reber, handled requests that Reber submitted to the engineering department and assisted him. A plea agreement was reached in Reber&#039;s case, and a separate indictment will be filed against him. In addition to the &#039;True Language&#039; affair described in the first charge, the indictment contains several additional charges relating to side affairs that were uncovered as part of the extensive investigation into the affair. The construction project was seized by the police, in order to prevent the project from continuing to be built, in a decision that received approval from the Supreme Court, and the state will seek its confiscation. The case was investigated by the National Unit for Combating Economic Crime (Yalak) in the Israel Police, together with the Jerusalem Investigation Tax Inspectorate, the Ramle VAT and the Money Laundering Prohibition Authority.
