The legal cases that have been exciting us in recent days are of great public and newsworthy value, as well as gossip of the highest order. A former prime minister, a former senior minister, a former chief of staff, Shula Zaken, all star in the great legal drama that has been presented before us in the past week.<\/p>\r\n
But what is taking place before our eyes is not a legal process but a kind of public execution or, by the more familiar name - lynching. Institutional lynching. Ehud Olmert was 'convicted' by the prosecution long before Judge Rosen read his harsh words in the courtroom. So was Silvan Shalom, and so was Avigdor Lieberman.<\/p>\r\n
It's hard to forget Edna Arbel's report on Ariel Sharon, or Elyakim Rubinstein's report on Ezer Weizmann. The two potential judges began a tradition of reports, the feeling emerging from which was "even if a conviction is not achieved, a public decision will in any case be achieved.".<\/p>\r\n
The phenomenon of the "institutionalized lynching" also includes the mayors of Ramat Hasharon, Nazareth Illit, and Bat Yam, who were forced to resign even before they were convicted. Let me remind you again, the three still have the presumption of innocence, which allowed them to run in the municipal elections and even win. Where has this presumption gone? Is it just because the court chose to rule that they are unfit to serve that they are disqualified from holding public office even when there is no conviction in their case? And what will happen on the day when it is proven, for the sake of this matter, that the mayor is acquitted, and that the prosecution wrongly treated him, will his status be restored, will he be able to rehabilitate his status?<\/p>\r\n
The presumption of innocence, it is important to remember, is a fundamental principle of criminal law. Violating the presumption of innocence, without providing the victim with any protection, is a serious violation of this basic human right that actively affects a person's right to a good name, to a livelihood, and even the right of the public to choose its representatives.<\/p>\r\n
The prosecution would do well to return to its classic role: investigating the issue in court.
