I was debating whether to write this column on Thursday (the business column) or Tuesday (the personal column). Because, on the one hand, it is a business matter, but on the other hand, it is a general matter, which is important for everyone to read and internalize.<\/p>\r\n

You decide.<\/p>\r\n

A week and a half ago, one of the readers from the site contacted me.<\/p>\r\n

He sent me an email asking for help. I called him, and here is the whole story (after completely changing the identifying details).<\/p>\r\n

Well, this is about a wealthy Abrevet from one of the Haredi cities, who had saved up his best money to buy an apartment. A certain person, well-known in the public, suggested that Abrevet "invest" in a certain commercial company. An "investment" that would yield him a fixed monthly profit from interest, calculated annually at 14%.<\/p>\r\n

Of course, the priest was quick to sign the "business permit" in order to cover up the internal doubts about the prohibitions of usury in the Torah (but that's not what this column is about).<\/p>\r\n

At the same time, when signing the "investment" contract, the investor stipulated that he required four guarantors, each of whom would sign a personal guarantee + deposit a surety check.<\/p>\r\n

So far everything is wonderful.<\/p>\r\n

The commercial company found a contract signed by four guarantors and gave him four of their personal checks.<\/p>\r\n

The contract explicitly states that if the investor wishes to withdraw his money before the end of the contract, 30 days' notice is required. In that case, the commercial company will be obliged to return the principal and interest differences within an additional 14 days.<\/p>\r\n

It turns out that the investor thought of every detail, and is properly protected from every possible direction.<\/p>\r\n

Do you have any spare money?<\/strong><\/p>\r\n

But here our plot gets complicated.<\/p>\r\n

The investor wanted to withdraw his money and gave advance notice. He patiently waited for the time specified in the contract.<\/p>\r\n

His patience ran out when the repayment date arrived. The company evaded repayment of the principal.<\/p>\r\n

The investor, in accordance with the stylish and protected contract, approached the guarantors and asked them to realize the guarantee.<\/p>\r\n

And then the "Baruch" began.<\/p>\r\n

The first evening he received the phone call, he was surprised by the nature of the conversation.<\/p>\r\n

\""Investor?" he asked. "Where? I signed a guarantee? Where?" he added in confusion. "Send the contract," he requested. "I'll check what you're talking about.".<\/p>\r\n

The contract was sent to the guarantor for consideration and it turned out that he was not signed at all and that his check had been "rolled in" regardless of the guarantor.<\/p>\r\n

The story repeated itself in one variation or another with the second guarantor. He claimed that he had signed a guarantee of one-tenth of the amount specified in the contract, and that he had been explicitly told that he was one guarantor out of ten others.<\/p>\r\n

The Arabs' claims were verified in 100% by me personally.<\/p>\r\n

It turns out that the contract was not signed in front of an attorney (despite the fact that it was explicitly stated in the contract), and the signatures of the "Arabs" were never verified (despite the fact that it was explicitly stated in the contract).<\/p>\r\n

Ultimately, after rapid intervention and the activation of various legal entities, the commercial company returned the fund to the "investor" and, thank God, he emerged unscathed.<\/p>\r\n

But I beg you, dear readers.<\/p>\r\n

Do you have some spare money? Want to invest or try to earn money beyond the interest rates that banks charge? Go ahead. Have fun.<\/p>\r\n

But remember! Investing in an external, uninstitutional entity directly entails considerable risk! There is no guarantee that the fund itself will return. Therefore, if it is your basic living expenses, do yourself a favor and avoid it, despite the promises of fat and quick profits.<\/p>\r\n

And remember one more thing: contracts are bound to be violated... Sit down with an attorney who is knowledgeable in the specific field (an attorney who specializes in wills and inheritances, no matter how senior, is not familiar with the field of investments!), and prepare every alternative and every possible defense for any eventuality that may arise.<\/p>\r\n

The cost of the lawyer will be clearly negligible compared to the loss of the investment and\/or the mental anguish and efforts (and costs) to recover.<\/p>\r\n

Don't be tempted to take shortcuts! If the lawyer suggests a certain process or a specific path, don't skip it, even with those involved in the case swearing to you that "everything is fine"...<\/p>\r\n

There is no fixed profit, there simply is none.<\/b><\/b><\/p>\r\n

And one last thing: there is (I repeat again. There is) no place in the world where you will receive a fixed interest rate without any dependence on the market situation and\/or profits and\/or the situation of the company or entity in which you are "investing.".<\/p>\r\n

After several huge stings and scams, an amendment was passed to the law prohibiting companies from guaranteeing a fixed interest rate or a predictable and secure profit on an investment in any industry or in any form.<\/p>\r\n

High penalties have been imposed on violators of the law and personal and vicarious criminal liability has been imposed on advertisers, and there are still lawbreakers who manage to circumvent the amendment.<\/p>\r\n

Take an iron rule (and I stand by my words): Any place that promises you a steady profit will end up being a scam. Sooner or later.<\/p>\r\n

This doesn't mean that you can't invest in different places in the Israeli or global economy, it doesn't mean that everyone is a liar and you should hide your invested money and withdraw it in hysteria.<\/p>\r\n

But it does mean that if you have "extra" money, or money intended for investment, and you are looking for an option to earn more than the banks' zero interest rates, it is highly advisable to consult with professionals.<\/p>\r\n

Back up your investment with double protections drafted by a qualified attorney, and pray hard that everything goes well.<\/p>\r\n
