So-and-so owes so-and-so money.<\/p>\r\n

Sometimes the winner\/plaintiff knows from somewhere that even if he sues a certain person, the debtor, then even if he wins, his chances of collecting his debt are slim, since that debtor is penniless or, alternatively, knows how to hide his money well, or will do his best during the trial period to "disappear" his money.<\/p>\r\n

As a result, he chooses not to sue at all. Later, the creditor learns that a certain person, the debtor, is entitled to receive money from an unknown third party. Then, the creditor can go to court, file a lawsuit and, within the framework of that lawsuit, request the imposition of a lien on the funds to which the debtor is entitled and which are held by that third party.<\/p>\r\n

It should be noted, and this is significant for the matter to be clarified below when discussing arbitration, and even more so arbitration according to Torah law, that the foreclosure process can be initiated, and after that - within seven days - the obligation to file a lawsuit also applies.<\/p>\r\n

It is worth emphasizing that sometimes the request to impose the seizure is submitted ex parte. That is, without the debtor being informed in advance, in order to prevent him from being able to thwart the purpose of the request - imposing the seizure on funds to which he is entitled and which are in the possession of a third party - before the order is received by that third party\/holder.<\/p>\r\n

The third party, to whom the attachment order was issued against funds held by him, is obligated to hold the money and not transfer it to the debtor until otherwise ordered by the court. Should the winner\/plaintiff prevail in his claim, the court will approve the transfer of the money directly from the third party to the winner\/plaintiff. This procedure, as mentioned, particularly facilitates the collection process and is sometimes decisive for the claim or not.<\/p>\r\n

The procedure presented above is a procedure that is carried out on a daily basis in the context of financial claims in court (it should be emphasized that the foreclosure procedure is reserved for financial claims only). But what happens when the parties seek to clarify their dispute within the framework of arbitration?[1]<\/sup><\/sup><\/a><\/p>\r\n

First, arbitration requires the signing of an arbitration agreement\/deed of arbitration, which grants the authority to adjudicate. Therefore, in the vast majority of cases, it is not possible, subject to the legal problems regarding the arbitrator's authority to issue a seizure order, which will be discussed below, to create a situation in which the arbitrator is authorized to issue a relief ex parte as a preliminary step to the arbitration process, unlike the possibility of obtaining a seizure order ex parte in court. This problem is a significant problem on a practical level, which can and does in fact render the seizure process unnecessary and futile.<\/p>\r\n

Second, the legal ruling on the granting of interim relief by an arbitrator is not unambiguous. Section 17 of the Supplement to the Arbitration Law grants the arbitrator the authority to grant declaratory relief, an order to do or not to do, an order for performance in kind, and any other relief that the court was authorized to grant. Section 16 of the Arbitration Law is the problematic section regarding the arbitrator's ability to grant interim relief, including the interim relief of attachment.[2]<\/sup><\/sup><\/a><\/p>\r\n

The problem, which can perhaps be seen as the central practical problem, even if the arbitrator is authorized to issue a seizure order, is the enforceability of this order.<\/p>\r\n

Although the arbitrator has the authority to rule that the defendant is obligated as if he had not defended himself - to delete his defense - if that party does not comply with the arbitrator's order, this remedy is draconian and problematic, and in any case, when it comes to a temporary remedy in the form of a seizure, it is an instruction to a third party who is not part of the arbitration proceedings and is not a party to them. In addition to the question of his obligation to act in accordance with the order, in any case, if he does not act in accordance with the order, no sanction of any kind can be imposed on him.<\/p>\r\n

There is another option, which is to apply to the court to approve the temporary relief,[3]<\/sup><\/sup><\/a> This point is also practical to a limited extent, as there is a question of whether the court in this case is a "rubber stamp" or can and will adjudicate on the merits of the matter.<\/p>\r\n

The above issues seem to cast a heavy practical shadow over the effectiveness of imposing a lien in arbitration. So, what is the most effective way to "seize" the money in the hands of a third party before it disappears?<\/span><\/p>\r\n

It seems that the most convenient and efficient way is to file a request for seizure and a lawsuit with the court, and upon receipt of the seizure order, transfer the dispute to arbitration, while leaving the seizure order issued by the court in its entirety, until the conclusion of the arbitration and the confirmation of the seizure order as part of the process of confirming the arbitration award.<\/p>\r\n

Taking this approach allows the plaintiff to enjoy the best of both worlds.[4]<\/sup><\/sup><\/a><\/p>\r\n
