{"id":160903,"date":"2015-04-23T11:56:50","date_gmt":"2015-04-23T08:56:50","guid":{"rendered":"https:\/\/ch10.co.il\/?p=160903"},"modified":"2025-08-07T09:36:21","modified_gmt":"2025-08-07T06:36:21","slug":"%d7%a6%d7%95-%d7%a2%d7%99%d7%a7%d7%95%d7%9c-%d7%96%d7%9e%d7%a0%d7%99-%d7%9e%d7%94-%d7%a2%d7%95%d7%9e%d7%93-%d7%9e%d7%90%d7%97%d7%95%d7%a8%d7%99-%d7%94%d7%9e%d7%99%d7%9c%d7%99%d7%9d-%d7%94%d7%9e","status":"publish","type":"post","link":"https:\/\/ch10.co.il\/en\/news\/160903\/","title":{"rendered":"\"&quot;Temporary Foreclosure Order&quot; \u2022 What&#039;s behind these scary words?"},"content":{"rendered":"<p dir=\"RTL\"><span style=\"line-height: 1.5em;\">After in previous columns we dealt with the various aspects of a claim for the division of property, this time we will deal with the order that can be requested as part of the management of this claim - which is a temporary seizure order (until a judgment is rendered, or any other decision).<\/span><\/p>\r\n<p dir=\"RTL\">I would like to emphasize that such a request can be submitted both as part of a claim for alimony and as part of a claim for the division of property - with this article focusing on the latter type.<\/p>\r\n<p dir=\"RTL\">\u00a0When a property claim is filed, it often becomes necessary to impose a lien on the property that we wish to receive in the future - all or part of it, when it is not registered exclusively in the plaintiff&#039;s name.<\/p>\r\n<p dir=\"RTL\">This is to ensure that no changes are made to the property until a judgment is rendered and the property is actually divided - which may take some time.<\/p>\r\n<p dir=\"RTL\">\u00a0If the court or tribunal decides to issue such an order, the seizure will generally apply to a maximum of half of the financial assets, since the assets are supposed to be divided equally between the spouses.<\/p>\r\n<p dir=\"RTL\">\u00a0When a foreclosure order is issued, the owner of the property cannot perform certain actions on it.<\/p>\r\n<p dir=\"RTL\">For example, if a lien is registered on savings, the owner of the savings will not be able to withdraw them, depending on the amount of the lien. That is, let&#039;s say he has 10,000 NIS in savings, and a lien is registered on 4,000 NIS, he is only allowed to withdraw a maximum of 6,000 NIS.
