An appeal by city council member Avraham Berger, from the Bnei Torah faction, to the Ministry of the Interior threatens to undermine the peace of Modi'in Illit, which has been turbulent since the last elections. Last week, we revealed here inHaredim10, <\/strong>that\u00a0<\/strong>Even though more than six months have passed since the local elections, the position of deputy mayor has not yet been legally approved in Modi'in Illit.<\/p>\r\n

In the letter, addressed to Mr. Avraham Emuna, Director of the Elected Officials Division in Local Authorities, Berger complains about approving the salary for a second deputy in the Modi'in Illit Municipality. As you may recall, the position of second deputy was assigned to Mordechai Goldberg from Degel HaTorah after the ruling of the Grand Rabbi Shteinman on the matter, while Agoyi representative and Karlin Hasidic figure Tuvia Freind claims that the position was promised to him by the mayor.<\/p>\r\n

What, exactly, is the debate about?<\/strong><\/p>\r\n

The saga began even before the elections, when the mayor, Yaakov Guterman, promised his paid advisor Tuvia Freind, a member of the Karlin Hasidic sect, that he would be given the position of deputy mayor. Following this promise, Freind officially resigned from his position, was elected as a council member, and waited for the promise to be fulfilled. The one who opposed the appointment, even before the elections, was MK Moshe Gafni. However, the decision was postponed until after the elections. Immediately after them, the Grail Shteinman determined that a member of the 'Degel Hatorah' faction, Mordechai Goldberg, would be appointed to the position.<\/span><\/p>\r\n

The mayor, Yaakov Guterman, was not enthusiastic, to say the least, about the decision. But after the matter was worsened by the "Grail", he could not appeal it. However, since then, time has been ticking, the excuses have only changed - and no one has sat in the deputy mayor's chair. Initially, it was an excuse that the Ministry of the Interior refrained from approving the appointment, since Goldberg stated that he was a member of the management of the "Meir" seminary in the city. Goldberg hastened to announce at the seminary that he was moving to work on a voluntary basis. Now the members of the municipality had to meet to approve the appointment, as required by law.<\/p>\r\n

But the meeting of the city council members was delayed.<\/p>\r\n

Before the news was published, a senior source close to the mayor claimed that the position had been confirmed. In the background, threats had already been made by Friend about an appeal to the court of the HaMera Da'Tara, Rabbi Meir Kessler. But his associates denied it. Last week, the appeal was officially made.<\/p>\r\n

The basis of the conflict between Friend and Goldberg is a budgetary demand by the former, which led to a financial dispute between them (which is hinted at in Gafni's words in his letter with the words "in darkness and various blackmails, neither public nor illegal"), something that cannot be detailed above this stage. Did the Bnei Torah movement, through its representative Avi Berger, volunteer to fight the war of the Agudat Israel representative, an associate of MK Yaakov Litzman, demanding the abolition of the deputy's position?<\/p>\r\n

There is no official evidence for this. The suspicions are the personal responsibility of each suspect.<\/p>\r\n

Friend sues in court, Gafni responds with attack<\/strong><\/p>\r\n

As mentioned, a few days ago, Tuvia Friend approached Rabbi Kessler's court, demanding that he be appointed to the position of deputy.<\/p>\r\n

In response, MK Moshe Gafni responded last night in a scathing letter:<\/p>\r\n

\""Rabbi Mordechai Goldberg sent me an invitation to a hearing before the Honorable Court regarding a lawsuit filed against him by Rabbi Tuvia Freind, and the invitation includes a quote "supported by the claim of appointments and the branch.".<\/p>\r\n

A.<\/strong> I would like to inform you that Rabbi Goldberg is an emissary sent by the "Degel HaTorah" movement, and if there is a claim, it must be against Degel HaTorah, against me as the Secretary General of the movement and as the list's attorney in Modi'in Illit.<\/p>\r\n

on.<\/strong> This is a political debate regarding both the position of deputy mayor and the deputy mayor's salary, which each party is fighting very hard over.<\/p>\r\n

third.<\/strong> We know that Mayor Rabbi Guterman was very interested in having Rabbi Tuvia Freind as the paid deputy, but the firm position of all the council members from Degel Hatorah and its members of Knesset was completely different and they all supported Rabbi Goldberg.<\/p>\r\n

D.<\/strong> I would like to emphasize that when submitting the lists, which was under my sole authority and was done according to the instructions of the Torah gurus and after consulting with my colleagues as was done in all the localities in which DGA contested, it was agreed between me and Rabbi Guterman that the list would be agreed upon by him, but the deputy would continue to be in the hands of the DGA representative.<\/p>\r\n

the.<\/strong> After various and strange maneuvers that the mayor and his partners who were not members of the DGA, all of us, members of Knesset and members of the council, appeared before Maran Grai'l Shtinman Shlita, who clearly instructed all of us to appoint the DGA member as deputy, and so Maran Grai'l Kanievsky Shlita ordered, and of course, to do as Maran Grai'l Shlita instructed.<\/p>\r\n

and.<\/strong> Only after receiving their instruction did Rabbi Tuvia Freind impose himself on Rabbi Mordechai Goldberg through obscurity and various blackmails, neither public nor illegal, when I informed Rabbi Goldberg that I was not authorized to speak to him at all on this subject, and indeed he immediately stopped speaking to him about it.<\/p>\r\n

G.<\/strong> All of us, without exception, are familiar with all the intrigues, intrigues, and personal issues that accompany both the mayor and his followers, and when the time comes, everything will be revealed. Since we learned that, among other tricks, the people of the municipality were asked to contact the Ministry of the Interior against a paid deputy and at the same time file a lawsuit before your Honorable Court on the matter, we, the three MKs of the DGA, and the secretary of the DGA Council was also present, approached the Maran Gerai'l Shtinman, Shlita, regarding the question of whether there is room for a lawsuit and whether we are required to appear at a hearing of this type, and he announced that this was his instruction as stated and that we would not appear at this hearing. A party is not sued when this is the instruction it lawfully received and there is no difference between the appointment of a deputy or a paid deputy.<\/p>\r\n

H.<\/strong> Not long ago, the court of the Grand Rabbi of Karelitz Shlita ruled in a lawsuit filed against me by several families from Gush Katif, stating that our delegation is the greatest of the generation and those qualified to judge us are the greatest of the generation. His Honor raised a number of issues in passing, and they are not relevant to our case, and therefore the court decided that this is a frivolous lawsuit.<\/p>\r\n

ninth.<\/strong> In light of the above, and in light of the instruction of Maran Gerail Shtinman Shlita, we will not sign an arbitration deed, and in any case, Rabbi Goldberg or any other person on behalf of the DGA will not appear for this hearing.".<\/p>\r\n

\u00a0\""The position is unnecessary, a waste of public money"\"<\/strong><\/p>\r\n

At this stage of the conflict, as mentioned, City Council member Avraham Berger, from the Bnei Torah faction, intervened and appealed to the Ministry of the Interior.<\/p>\r\n

And this is what Avi Berger wrote:<\/p>\r\n

\""I have learned that you have requested clarification regarding the appointment of the second deputy mayor, Mordechai Goldberg. I hereby inform you of the following details:<\/span><\/p>\r\n1.<\/strong> By law, delegation of authority is not a condition for approval of salary payment for deputy heads of local authorities by the Minister of the Interior. Thus, according to sections 115 and 119 A (b) of the Local Councils Order (A), 5711 1950 and section 35 B (a) of the Councils Ordinance. Section 17 of the Election Law, which deals with delegation of authority, also explicitly states that the fulfillment of the duties and use of the delegated authority shall not entail payment of salary. The connection between approval of salary payment and delegation of authority was determined in an internal directive contained in a circular from the Director General of the Ministry of the Interior.\r\n2.<\/strong> The purpose of the directive is that only deputy heads of authorities who actually exercise functions and powers in the local authority will be entitled to payment of a salary from the authority's treasury. For, it is clear that "there is no justification for paying a salary from the council's treasury to a deputy head of a council unless he bears, by virtue of delegation of powers, the actual burden of managing an authority.".\r\n3.<\/strong> In light of the above, the deputy who receives a salary must hold an executive portfolio with powers, and the mayor must delegate some of his powers to the deputy holding the portfolio, and without delegation of powers and without an executive portfolio, it is prohibited by law to grant a salary to the deputy mayor.\r\n4.<\/strong> Second Deputy Mordechai Goldberg was appointed to hold the absorption portfolio two months before the issue of his appointment as deputy was raised. While the absorption portfolio is a function that does not exist at all in the municipality, but is only an 'honorary title'.\r\n5.<\/strong> From my inquiries at the municipality and the Finance and Treasury Department, I learned: A. There is no such department at all. B. There are no offices for the absorption department and there are no officials who function or serve in the 'absorption department'. C. The municipality's activity in the field of absorption amounts to a total budget of approximately 60,000 NIS per year (!) so that the budget of the 'department' (which does not exist) per month is only 5,000 NIS! D. The absorption budget in the municipality is implemented by the municipal administrator, who is under another department.\r\n6.<\/strong> I asked: Is it possible that the deputy's annual salary is 650,000 NIS while the entire budget of the department he is supposedly in charge of is only 60,000 NIS, 10 times more?\r\n7.<\/strong> Therefore, I will request that the budget of the second deputy be prevented from being approved, as long as it is not an executive file, one that includes practical content that is carried out in the field, which does not exist today, as stated.\r\n

It should be emphasized that as public representatives, we must demonstrate public and personal responsibility towards public funds. Especially when the municipal treasury is unfortunately in a severe deficit that required the mayor to seek approval from the municipal council plenum in recent days to request a bank loan in the amount of millions of shekels.<\/p>\r\n
