I should note that this claim can also include a claim for spousal support, but this article will only deal with the issue of minors (Article dealing with spousal support). <span style=\"text-decoration: underline;\"><a href=\"https:\/\/ch10.co.il\/en\/news\/122221\/#.VM_RLGisXxE\">Posted by here before<\/a>)<\/span>.<\/p>\r\n<p dir=\"RTL\">In terms of the court to which the lawsuit will be filed, the mother of the minors has the right to choose whether she wants to file the lawsuit in the Family Court or the Rabbinical Court.<\/p>\r\n<p dir=\"RTL\">Even if the husband &quot;preempted&quot; her and filed a divorce suit with the court, in which he included the issue of child support - the wife is entitled to file a suit for child support in court - and the court will have jurisdiction over this matter.<\/p>\r\n<p dir=\"RTL\">When a judge or a judge in a rabbinical court approaches a child support order, he examines three main criteria:<\/p>\r\n<p dir=\"RTL\">1. The father&#039;s income, assets, and earning potential \u2013 that is, how much he earns now and how much he is expected to earn in the future \u2013 even if he is currently unemployed, or works part-time, or even if the husband is unemployed because the couple agreed to this in the past. As part of this examination, they also examine what assets the father has (which he can supposedly sell to pay child support).<\/p>\r\n<p dir=\"RTL\">\u00a02. The mother&#039;s income, assets, and earning potential \u2013 even if she is not currently working, or works part-time.<\/p>\r\n<p dir=\"RTL\">\u00a03. The children&#039;s actual needs - how much did the parents actually spend on their children during the parties&#039; marriage, what was the standard of living, and whether there were any special expenses.<\/p>\r\n<p dir=\"RTL\">\u00a0According to the personal law applicable to Jews (both claims in the Family Court and in the Rabbinical Court), the father must finance the necessary needs of his children, especially when it comes to relatively young children (under the age of 6), even if he does not work or if his salary is not high. However, the mother must participate in needs that are beyond the necessary, depending on her income and the age of the children (over the age of six).<\/p>\r\n<p dir=\"RTL\">\u00a0<b>What is included in child support?<\/b><\/p>\r\n<p dir=\"RTL\">The calculation of alimony is divided into several components.<\/p>\r\n<p dir=\"RTL\">A. &quot;Basic support&quot; component - necessary and basic expenses of the child (mainly household expenses and clothing). The court usually rules for this component at approximately 1350 NIS per child. I would like to point out that sometimes, when there are several children, a sum of 1350 times the number of children will not necessarily be ruled, as some of the expenses overlap, and the standard of living must also be examined.<\/p>\r\n<p dir=\"RTL\">B. Participation in the expenses of the section - rent or mortgage, and maintenance of the section - property taxes, electricity, water, telephone, and house committee. The amount of the charge is based on the number of minors, and a maximum of 50%.<\/p>\r\n<p dir=\"RTL\">\u00a0C. Educational expenses - Each parent must bear half of the educational expenses (kindergarten\/school\/afterschool), however, the court may limit the amount for this component to the amount accepted in the place of residence. In certain cases, the parties will be required to pay half of the expenses for classes, summer camps, and tutoring when it is proven that this is indeed necessary.<\/p>\r\n<p dir=\"RTL\">D. Extraordinary medical expenses - the parties are generally supposed to cover this expense equally.<\/p>\r\n<p dir=\"RTL\">\u00a0<strong>Nothing in this article is intended to replace individual legal advice, and each case must be examined on its own merits.
