The Competition Authority officially notified Carmel Wineries today (Tuesday) - the cooperative winegrowers' association of Rishon Lezion Wineries Ltd. and Zichron Yaakov Ltd. - that it is considering using its legal authority and declaring the company a monopoly in the supply of must and wine for Kiddush in Israel. <\/p>\n\n\n\n
The move is subject to an official hearing being held for the company before the Competition Commissioner.<\/p>\n\n\n\n
The basis for the move began during the review of the merger between Carmel Wineries and Erza Winery, after a comprehensive investigation conducted by the Competition Authority at the time revealed clear findings, according to which Carmel Wineries' share exceeds half of the total supply in the must and wine markets for Kiddush, and that it holds significant and very dominant market power in these markets. <\/p>\n\n\n\n
The Authority's inspection findings also received official approval from the Competition Court at the time. <\/p>\n\n\n\n
New data recently collected by the Authority seemingly indicates that Carmel's position in the relevant markets remains strong and that there has even been a further increase in its market share.<\/p>\n\n\n\n
Declaring Carmel Wineries a monopoly will impose additional obligations and strict restrictions on it by virtue of the Law for the Promotion of Competition in the Food and Pharmaceutical Industries, known as the Food Law.<\/p>\n\n\n\n
Once the hearing process is completed and the company is indeed declared to have a monopoly, all provisions of the Food and Pharmaceutical Law will apply to it in relation to the markets that appear in the declaration.<\/p>\n\n\n\n
Under the new restrictions, Carmel Wineries will be prohibited from interfering in any way with the arrangement of the shelves of its products in major food chains, and it will be prohibited from making the sale of a certain sought-after product conditional on the purchase of another of the company's products. <\/p>\n\n\n\n
