MK Yinon Azulai, chairman of the Shas faction in the Knesset, today (Wednesday) filed a complaint with the Ombudsman for Judges, retired Judge Asher Kola, against three Supreme Court justices - Yitzhak Amit, Khaled Kabob, and Yechiel Kasher - claiming that they violated the Work and Rest Hours Law by ordering civil servants to work on Shabbat.<\/p>\n\n\n\n
The complaint refers to a hearing held on a petition filed by protest activists in the High Court of Justice, in which they demanded that demonstrations be permitted in several locations across the country despite restrictions prohibiting gatherings imposed in the wake of the 'Roar of the Aryans' war.<\/p>\n\n\n\n
The petition was scheduled for hearing on Friday, April 3, and the judges ordered the respondents to submit their position no later than Saturday at 11:00 AM.<\/p>\n\n\n\n
After the state submitted a position that did not satisfy the composition, the judges ordered during the Sabbath to submit another update notice by 6:00 p.m. Ultimately, the judges issued an interim order ordering the state to allow demonstrations in four locations - contrary to the Home Front Command's recommendation.<\/p>\n\n\n\n
Azoulay claims in his complaint: "The conduct of the honorable court hearing the petition violates this prohibition, both because among the members of the panel there are Jews who were employed on the Sabbath, and because the panel ordered the respondents to submit update notices during the Sabbath on several occasions.".<\/p>\n\n\n\n
According to Shas, the court relied on regulations that permit hearings on rest days in cases of "pikuach nefesh," but in fact this was not the case.<\/p>\n\n\n\n
Azoulay lists four reasons for this: First, the exception in question was supposed to be in effect until May 1 and was not urgent. Second, the judges' dissatisfaction with the position of the professional bodies does not constitute "pikuach nefesh." Third, the fact that the judges ordered that larger gatherings be allowed than recommended indicates that there was no security concern. And fourth, scheduling another hearing nine days later indicates that there was no real urgency.<\/p>\n\n\n\n
Azoulay cites a previous decision by retired Vice President Noam Solberg, who stated: "The judicial decision according to which a person in Israel and a civil servant was required to work on Shabbat, the day of rest in the State of Israel - is unjustified.".<\/p>\n\n\n\n
The Judiciary Spokesperson clarified after the storm that erupted: "The panel did not grant the request to hold a hearing on Shabbat, and the two decisions made during Shabbat were made after a telephone consultation between the judges, so no employee was brought to court.". <\/p>\n\n\n\n
However, Azoulay claims that the instruction to civil servants to submit notices during the Sabbath constitutes a violation of the Working Hours and Rest Law.<\/p>\n\n\n\n
