The abuse of the Tel Aviv Municipality: Insisted on fining a survivor from Nova • What did the judge rule?

A young woman who was seriously injured at the Nova party in Ra'im on October 7, and who suffers from a 3T disability, was fined for riding a scooter without a helmet - an offense committed shortly before the terrorist attack.

According to Avishai Greenzig's report in i24NEWS, this is where a Kafkaesque series of abuse began on the part of the Tel Aviv Municipality - which insisted throughout the entire legal process on imposing the original fine on the survivor in full, even after documents were presented attesting to her severe physical and mental harm.

The young woman was unable to attend the hearing herself, and her mother appeared in her place and presented her circumstances.

Judge Moshe Srogovitch rebuked the municipality for its decision, writing that if there are no special circumstances in this case that justify relief, no such case will be found.

He said, "The defendant admitted her guilt in writing and requested that it be taken into account in the matter of the amount of the fine. Special and exceptional circumstances also arose that justify a significant reduction in the amount of the fine. If there are no special circumstances in this case, there will be no case that will have them. Someone who survived the horrors of 10/7/23 deserves the full consideration of the court, certainly for a previously committed offense of choice of law. Therefore, the defendant will pay a fine of a symbolic nature only.".

The judge ordered the fine to be reduced to a symbolic amount of only 5 shekels, emphasizing that these are "special and exceptional circumstances that justify a significant reduction.".

The Tel Aviv Municipality responded: "Taking into account the circumstances and condition of the perpetrator of the offense, the prosecution spoke with her mother and offered to reduce the amount of the fine, but the mother refused the offer. We emphasize that this is a life-threatening offense - riding without a helmet - which was committed before the events of October 7, and that maintaining public order and the safety of residents is our highest duty as a local authority.""
