Supreme Court reverses district court decision: Some charges in Bezeq case will not be dismissed

The Supreme Court today (Thursday) reversed the decision of the Tel Aviv District Court, effectively accepting the state's appeal - and reinstated the charges against Shaul and Or Elovitch and other defendants in the Bezeq affair.

Following the decision, the charges will continue to be heard in court.

The charges included offenses of fraud and breach of trust in a corporation, receiving something by fraud, and offenses of including a misleading detail in a report in order to mislead the investing public.

This is against the backdrop of leaking materials and documents from independent committees established as part of the approval procedures for the "Bezeq-Yes deal" which led to the merger of the companies Bezeq and DBS Satellite Services (1998), and the "Yes-Space deal" - in which Yes purchased satellite broadcast segments from Space Communications.

In the district court's decision, both charges were dismissed on the grounds that the facts detailed therein did not reveal an offense.

In the ruling issued, the Supreme Court determined that it cannot be clearly said that there is no basis for convicting the defendants of the offenses they were accused of.

Last year, District Judge Michal Agmon Gonen ruled that some of the charges in the Bezeq Securities case do not reveal guilt, thereby dismissing some of the charges in the case against Shaul Elovitch, former owner of Bezeq.

In addition to the charges against Elovitch, the court dismissed all charges against Linor Yochelman, Amikam Shorer, and Or Elovitch, the owner's son.

This case "gave birth" to Case 4000 in the Netanyahu trial, in which Elovitch and Prime Minister Benjamin Netanyahu are accused of bribery.
