"אכן, לא פעם עסקינן בפושטי יד וקבצנים מטרידים, אולם הרחקתם מהמקום לתקופה ממושכת פוגעת בכבודם, שממילא נפגם בהיותם פושטי יד, ובמקרים מסוימים, עלולה הפגיעה לעלות כדי השפלה, בבחינת 'אינכם רצויים במקום זה'".

The ruling further stated: "The issue of this decision is the question of the authority of the Commissioner of Holy Places to remove a person from the Western Wall area. More specifically, the question arises whether the removal authority granted to the Commissioner of Holy Places in the regulations is limited to the authority to remove physically and specifically (as the defense believes), or whether the removal authority granted to him also extends to issuing removal orders from the Western Wall area for a significant period of time of up to sixty days (as the prosecution believes).

 ""In conclusion - I believe that the removal order issued against the defendant was issued without authority, and therefore cannot be considered a 'properly issued order.' In the absence of authority to issue the order, the defendant did not violate a legal order upon arriving at the Western Wall plaza. The conclusion is therefore that the defendant did not commit an offense.".
