Legal Advisor: 'VAT Benefit' Law Harms the Equality of Haredim

לקראת הדיון הצפוי בהטבת מע"מ בשיעור אפס של משרד האוצר בוועדת השרים לחקיקה ביום ראשון הקרוב, פורסמה הצעת החוק המעודכנת לעיון השרים. במסגרת הצעת החוק פורסמה גם עמדת היועץ המשפטי לממשלה יהודה וינשטיין, המתריעה בפני שאלות חוקתיות שמעלה הצעת החוק בשל ההפרדה בזכאות להטבה בין מי ששירת בצבא או בשירות לאומי-אזרחי ובין מי שלא. ""The purpose of the proposal to grant preferential benefits to those who have served the country," writes Weinstein, "is intended to honor the servants and compensate for the financial disadvantage they have suffered. This purpose is a worthy one. ""At the same time, this distinction excludes the vast majority of the Arab and Haredi population from being beneficiary purchasers and may result in a violation of equality," according to the Attorney General. "The distinction between those who have served the state and those who have not is not an invalid distinction, if it is relevant to the purposes of the specific arrangement in question, provided that it is reasonable and proportionate. ""The line of demarcation on this matter is not sharp. The bill therefore raises constitutional questions. However, in light of the changes made to the memorandum since it was circulated for public comment and following the Attorney General's comments, there is no legal impediment to its advancement.". The Attorney General's position also stated: "The bill does not regulate the way the benefit is distributed among those eligible for it. According to the data we have, at least in relation to the near future, the supply of apartments will be significantly lower than the number of eligible persons. This situation, in which there is a significant excess of demand over supply, is likely to lead to the accumulation of great power in the hands of the selling contractors and raises concerns about irregularities in relation to the manner in which the benefit is realized by those eligible for it, and perhaps even its abuse.".  The updated bill set a new threshold for the value of a beneficiary apartment for someone who did not serve in the army and does not meet the criteria set by the Ministry of Finance, which is NIS 950,000 (including VAT), compared to NIS 600,000 (including VAT) set in the initial memorandum of law. Another change in the legal memorandum that will be published on Sunday relates to the implementation of the law: No certificates of eligibility will be issued, but rather those who consider themselves eligible will fill out a questionnaire and a declaration that will be published online, and with it the purchase of the apartment will be made, backed by a lawyer's signature. מי שירכוש דירה שנקבעה כי עומדת ברף המחיר שקבע השמאי הממשלתי לקבלת ההטבה, יעביר את ההצהרה לקבלן ולאחר ביצוע העסקה יעביר האחרון את ההצהרה יחד עם מסמכים נוספים של הרוכש המעידים על עמידתן בקריטריונים לרשות המיסים. שם יאשרו את הזכאות לאחר בדיקה ויאושר קיזוז המע"מ מהמחיר. הצעת החוק המעודכנת קובעת גם באופן מפורש עונשים למי שיפר את הקריטריונים או את תנאי החוק, הן מצד הרוכשים והן מצד הקבלנים, ומציינת עונשי מאסר של בין שנה ל-5 שנים. עלות ההטבה למדינה על פי הצעת החוק היא 2.4 מיליארד שקל בשנה.
