Supreme Court: The Attorney General will answer by Thursday why she will not refrain from dealing with the Magistrate's case

The Deputy President of the Supreme Court, Justice Noam Solberg, ruled this evening (Tuesday) that Legal Advisor to the Government Gali Baharav Mayara will be forced to respond within 36 hours - by Thursday at 12:00 noon, to the petition submitted by petitioners MK Avichai Boaron and the Lavi organization.

The petition demands that the Ombudsman refrain from any involvement in the investigation into the case of the fired MP and the investigation into the leak of the video from 'Yemen Field'.

MK Boaron and the Lavie organization, represented by Attorney Itzik Bem, petitioned the High Court of Justice earlier this week to prevent the Attorney General from conducting the investigation into the leak of the video from "Yemen Field.".

Today, the two petitioners, through their attorney, Attorney Yosef Ben Baruch, filed a request for urgent exhaustion of proceedings - to open a criminal investigation against the Legal Advisor to the Government, Attorney Gali Baharav-Miara, on suspicion of committing offenses of obstruction of investigative proceedings, abuse of office, fraud, and breach of trust.

The letter was submitted to Commissioner Danny Levy, and to the head of the Intelligence and Investigations Division, Chief Boaz Blatt, demanding that the police immediately open an investigation and order the seizure of Baharav-Miara's cell phone, out of real fear of disrupting the investigation and destroying evidence.

The appeal relates to the conduct of the attorney general in the case of former MPA Yifat Tomer-Yerushalmi, who is suspected of obstructing and covering up the investigation into the leak of the video from 'Yemen Field'.

According to the allegations, Attorney Baharav-Miara was personally involved in key decisions in the case, despite a clear conflict of interest, and thus exceeded her authority and allegedly acted in a manner that harmed the course of the investigation.

The letter states, among other things: "A situation in which the Legal Advisor to the Government is herself conducting an investigation concerning elements that operated under her, when her actions are also at the heart of the events - is a fundamentally wrong situation. This is a clear conflict of interest that undermines public trust and requires the opening of an immediate criminal investigation.".

It was further claimed that the Attorney General's decision not to seize Tomer-Yerushalmi's cell phone, despite early warnings, led to the loss of key evidence in the case, which strengthens the suspicion of obstruction of the investigation and an attempted cover-up.

The announcement states that if the police do not immediately open an investigation, MK Boaron and the Lavi organization intend to petition the competent courts to ensure an independent and thorough investigation.
