The Jerusalem Magistrate's Court ruled that an Arab who attacked an 80-year-old Jewish man in Jerusalem four years ago and seriously injured him will serve eight months of community service and pay the Jew 15,000 shekels in compensation.

The Jew is accompanied by attorney Haim Bleicher, director of the Honenu Victims of Hostility Department.

The elderly man, who was on his way to dialysis, approached the Arab after his scooter was stolen, claiming that he was the thief while laying his hand on him. The Arab pushed the elderly man to the floor and fled the scene.

One of the elderly man's family members witnessed the attack, and when he ran to help him, he was sprayed with tear gas by the attacker.

As a result of the attack, the elderly man suffered serious injuries and fractures, and he was hospitalized for many weeks.

After the attack, the elderly man's daughter went to the police station to file a complaint on behalf of her hospitalized father, but the police responded that she could not file a complaint, since she was not present at the scene at the time of the incident.

Honenu led a long legal battle, which ended with indictments being filed against the attacker.

The indictment filed against the Arab describes the brutal attack: "On 17.8.21, the complainant approached the defendant and his friend and accused them of stealing his movie theater's luggage. Under the same circumstances, the complainant placed his hand on the defendant. At that time, the defendant pushed the complainant forcefully with both hands, the complainant fell to the ground and the defendant fled the scene. As a result of the defendant's actions, the complainant suffered injuries in the form of a fracture in the neck of the right femur with displacement, a fracture in the right hand at the olecranon, and abrasions that required a cast to be placed on the hand, hip surgery to restore and internal fixation with a plate and screws, and the administration of blood transfusions.".

Attorney Bleicher: "Such a violent attack on an elderly person by a minority offender stems from hatred and a desire to harm indiscriminately, even when it comes to an elderly person, and this is simply because he is Jewish. This is a dangerous offender who belongs in prison. Although existing case law has few cases of imprisonment in these circumstances, this is an exceptional case in its cruelty, as it concerns an elderly person who has suffered great harm. In any case, the sentence that was ultimately obtained is also significant, and it was also received due to the great effort to clarify the seriousness of the incident, both to the prosecution and to the court, and the effort of the elderly Jew to come to court despite his condition and demand justice for the offender. We will continue to work to make the punishment more severe and demand real imprisonment, because the safety of the loyal citizens of Israel must not be compromised.".
