
A brother and sister, residents of Petah Tikva, who live a religious lifestyle, are suing the Osher Ad writers' chain for 75,000 shekels.
According to a report by Yaron Doron in Israel Hayom, a lawsuit filed yesterday with the Petah Tikva Magistrate's Court alleges that, although Osher Ad is aimed at the Haredi public and declares Mehadrin kashrut, it sold a leavened bread product at its Petah Tikva branch during Passover - and caused the brothers to eat leavened bread on Passover.
According to the lawsuit, during Passover, the brother came to a branch of the Sofer chain in Petah Tikva. "Plaintiff 1 relied on the defendant, since she states that she operates with a rabbinical permit and under the supervision of kosher bodies from the Mehadrin, and purchased a 'gnocchi' type product from the manufacturer, on the reasonable and reasonable assumption that it was a kosher product for Passover. There was no marking on the product shelf or anywhere else indicating that the product was leavened.".
The brother and sister prepared and ate the gnocchi at home. The brother then looked at the packaging and saw that wheat flour was listed among the ingredients. "Upon learning this, the plaintiffs were struck with astonishment and deep shock. The mere knowledge that they had eaten leaven during Passover - an event that constituted a serious violation of their religious conscience and way of life - caused them severe feelings of humiliation, insult and intense sorrow.".
The lawsuit claims that this is consumer deception and, in addition, according to the law, any business owner is prohibited from publicly displaying leavened bread products during Passover.
It was further claimed that there was also negligence, violation of autonomy, violation of mandatory disclosure, and mental anguish in the case.
Osher Ad did not provide a response to Israel Hayom.
