""I led with handcuffed detainees": Guy Lehrer from 'The Pipe' questioned over video

גיא לרר, מנחה תכנית 'הצינור' בערוץ 10, חשף היום (רביעי) בדף הפייסבוק שלו כי נחקר באזהרה במפלג ההונאה של משטרת ישראל, בעקבות טענה של המשטרה כי פרסם חומרי חקירה אסורים. על פי לרר, הסיבה לכך היתה פרסום של סרטון שהפיק הפעיל החברתי, עו"ד ברק כהן, על שוטר מתחנת מוריה. "החלטתי להוציא את זה כאן לפני שתגיע איזו הדלפה מכוערת שאחריה אצטרך רק להתגונן", כתב לרר. "זומנתי לחקירה באזהרה במפלג הונאה של המשטרה. הובלתי יחד עם עצורים הכבולים באזיקים בידיהם וברגליהם לחדר טביעות האצבעות וצולמתי במאג שוט. האשמה: 'פרסום חומרי חקירה אסורים', סיפר לרר. איש הטלוויזיה הוסיף: "מהם חומרי החקירה האסורים? סרטון סאטירי של עו"ד ברק כהן נגד אחד השוטרים בתחנת מוריה בירושלים. החברים של השוטר מהתחנה זימנו את ברק כהן לחקירה מדוקדקת שבשיאה ניגנו לו את השיר מיו-טיוב. אני שידרתי את החקירה המוזרה על הסרטון ההיתולי שעלתה כבר בפייסבוק ונצפתה על ידי עשרות אלפים, ועכשיו אני חשוד בעבירה שדינה עד שנת מאסר. בחקירתי נכח ראש מפלג ההונאה. עד כדי כך". "אין לי פה עניין להצטייר כקורבן. החקירה היתה אדיבה ובשום אופן לא חוויה טראומטית או משהו שמתקרב לזה אפילו. העניין הוא עקרוני. בשיחות שניהלתי עם החוקרים הגענו לדיון ער על הביקורת שאנחנו מותחים ב'צינור' על תפקוד המשטרה לאורך שנים. אולי במקרה, אולי לא. "שאלתי האם חקירות פריצה, גניבות ואלימות זוכים לאותה תשומת לב כמו אותה חקירת ענק על העלבת שוטר. בינינו, אין צורך אפילו להשיב על השאלה הזו. אולי מטרת החקירה היתה להפחיד או להלחיץ? אולי. זה די מלחיץ כשמרחפת לך על הראש שנת מאסר ואתה מחכה לתת טביעות אצבע בחדר מלא שקשוקי אזיקים". בעקבות החקירה, שיגר ארגון העיתונאים מכתב בהול למפכ"ל המשטרה הנכנס, רוני אלשיך, עליו חתום יאיר טרצ'יצקי, יו"ר ארגון העיתונאים בישראל: 1. The procedure states that "the police are required to exercise great restraint in exercising their powers under the law and to exercise them only after exhausting all alternative avenues of investigation." The procedure states that if the need arises to interrogate a journalist or conduct a search, the investigation material will be forwarded for approval to the head of the Investigations and Intelligence Division, who will decide on the execution of the action. The procedure emphasizes that a journalist will be summoned for questioning only if all of the following conditions are met: this is the only way to obtain the information needed for the investigation, the information in his possession is essential, and the offense being investigated is serious. Before making a decision to summon him for questioning, the head of the Investigations and Intelligence Division must inform the Commissioner and obtain his approval, and if necessary, he will also consult with the State Attorney or the Press Council. The head of the division himself, it is written, is supposed to guide the conduct of the investigation. 4. Were the conditions and instructions specified in this procedure actually met? How and by whom was the decision made to summon the journalist for questioning? 5. In light of the above, it is implied that there is no factual justification for the decision to take such an unusual step of interrogating a journalist in the police, and the feeling is created that this is an attempt to terrorize a journalist who dares to criticize the police. On the sidelines, it is even puzzling why the police chose to summon for questioning the program's host, who may be the most famous on the team but is not responsible for the content, which raises concerns of an attempt to create a deterrent effect in the sense of "so that they may be seen and feared.". We see this as an inappropriate attempt to convey a message to Lerer himself, who often criticizes the functioning of the police in the course of his duties, but the harm is not only a personal harm to him, but an harm to the entire journalistic community, and in doing so also to the public's right to know and the duty of the press to expose wrongdoing. This harm has a chilling effect on our ability as journalists to fulfill our role and criticize the police without fear. 6. We call on you to announce the closure of the case, and to clarify for your subordinates the procedure for investigating journalists. 7. This is yet another case that joins the sad record of police mistreatment of journalists in Israel. We would be happy to hold a meeting as soon as possible to discuss this issue and how we can work together to improve the situation.
